What Changed Recently?

Magistrate Judge Gabriel A. Fuentes of the U.S. District Court for the Northern District of Illinois granted preliminary approval at a hearing on September 11, 2026 and entered the written preliminary approval order on September 14, 2026. The order certified a settlement class, appointed Kroll Settlement Administration LLC as settlement administrator and set the December 3, 2026 deadline for claims, exclusions and objections.

The case, L.C. v. Fertility Centers of Illinois, PLLC, was filed on February 27, 2025. It alleges that Fertility Centers of Illinois (FCI), a fertility care provider, embedded Google and Facebook advertising tracking technology on its website, fcionline.com, which disclosed visitors’ information and website activity to those companies without consent. The complaint claims this violated the federal Electronic Communications Privacy Act, the Illinois Eavesdropping Statute and Illinois common law. The court denied FCI’s motion to dismiss in December 2025, a ruling on the pleadings rather than on the merits, and the parties settled after court-supervised settlement conferences in 2026. FCI has not admitted liability, and the preliminary approval order states that the settlement is not a finding or admission of liability by FCI.

Who Qualifies?

The settlement class is all persons in the United States who, from September 1, 2020 through December 31, 2024, accessed and used FCI’s website, www.fcionline.com.

Excluded are the judges presiding over the case and their staff and families; FCI and its subsidiaries, parents, affiliates and their current or former officers, directors, agents, attorneys and employees; anyone who submits a valid request for exclusion; and the legal representatives, successors or assigns of excluded people.

How Much Can Class Members Get?

FCI will pay $375,000 into a non-reversionary settlement fund, so none of it returns to FCI. Settlement administration costs, attorneys’ fees and costs, and a service award to the class representative are paid from the fund first. Class counsel has said it will ask for no more than 35% of the fund in fees plus up to $10,000 in costs, and the requested service award is $10,000, all subject to court approval.

Everyone who files a valid claim receives an equal pro rata share of what remains. Class counsel estimated each claimant’s net payment at about $30 to $60. That is an estimate: the actual amount depends on how many valid claims are filed and on the fees and costs the court approves. Money from checks left uncashed after 180 days goes back into the fund for another pro rata distribution to claimants if practicable, or as the court directs.

What Proof or Notice ID Is Required?

The claim form does not ask for receipts, medical records or other documents. The court filings describe a simple claim form that can be filed online or downloaded and mailed.

Notice went to class members by email, with a reminder email before the deadline. Settlement claim forms commonly ask for the claim or class member ID printed in that email, and the live online form on the settlement website could not be checked for this page, so it is listed here as possibly requiring an ID. People who used fcionline.com during the class period but did not receive an email can check the settlement website for how to file without one.

What Is the Deadline?

Claim forms must be submitted on the settlement website or postmarked by December 3, 2026. December 3, 2026 is also the deadline to request exclusion or to object. The court’s order does not state a time of day or time zone for online submissions.

How Do Class Members Take Action?

The official Fertility Centers of Illinois settlement website is where claims are filed online; under the settlement it also carries a downloadable paper claim form, the notice and the case documents. Questions go to the settlement administrator, Kroll Settlement Administration, through the settlement website.

Class members who do nothing receive no payment and are still bound by the settlement and its release if the court grants final approval. A class member who requests exclusion by December 3, 2026 receives no payment, is not bound by the settlement and cannot object to it.

What Happens Next?

Class counsel must file its fee and service award request by November 19, 2026, and the plaintiff must file papers supporting final approval by December 30, 2026. The final approval hearing is scheduled for January 13, 2027 at 10:30 a.m. in Courtroom 2266 of the Dirksen U.S. Courthouse in Chicago; the court may move the hearing without further notice. Payments go out only after final approval, and no payment date had been announced as of October 23, 2026.
