What Is the Plainridge Park Casino Class Action About?

You may be part of a new class action settlement if you were a member of Plainridge Park Casino's rewards card program and gambled at the casino during the last several years.

In August 2021, several rewards card members filed a lawsuit called Katopodis et al v. Plainville Gaming and Redevelopment, LLC d/b/a Plainridge Park Casino in the Superior Court of Massachusetts, Suffolk County. The plaintiffs claim that Plainridge Park Casino failed to send monthly statements to rewards card members showing their total bets, wins, and losses or to provide notices explaining how to obtain that information. They allege this violated Massachusetts law.

Plainridge Park Casino denies all wrongdoing and says it complied with the law. Instead of continuing with a trial, both sides agreed to settle the case and create a $4.175 million Settlement Fund that will pay automatic awards to eligible rewards card members.

Who Is Included in the Settlement?

According to the official notice, the settlement class includes members of Plainridge Park Casino's rewards card program who:

• Gambled at Plainridge Park Casino between August 25, 2017 and November 30, 2023
• And had also gambled at Plainridge Park Casino at least once in the two years before each of those visits

The casino's records were used to identify settlement class members, so if you received an official notice then you have already been identified as part of the settlement class.

How Much Will I Get Paid?

Plainridge Park Casino will pay $4,175,000 into a Settlement Fund. After the court approves payments for administration costs, attorney fees and expenses, and incentive awards for the class representatives, the rest of the fund will be used for class member payments.

There are about one hundred and thirty thousand settlement class members. The notice estimates that each class member, including you, will receive a Settlement Award of approximately $21.50. If any class members do not claim or cash their payment within ninety days of issuance, those amounts will be treated as residual funds and donated to a problem gambling charity or another court approved recipient.

Do I Need to File a Claim?

No claim form is required in this settlement. You can just select the payment method if you are already part of the settlement.

Plainridge Park Casino's records have already identified who is in the settlement class. If the court grants final approval, payments will be issued automatically to qualifying members using the contact information on file and any updated details you provide to the settlement administrator.

You will be able to log in to a secure portal on the settlement website and choose how you want to be paid.

How Will I Receive My Settlement Award?

If the settlement becomes final, the settlement administrator, Kroll Settlement Administration LLC, will send out payments from the fund.

• You will be able to choose a preferred payment method through a secure portal on the settlement website
• Options will include electronic payment methods such as Zelle or another digital service, or a physical check mailed to you
• If you do not select a payment option within thirty days after final approval, the administrator will send your payment using the method it considers most appropriate

If you do not negotiate or accept your payment within ninety days of issuance, your award will be forfeited and the money will be treated as residual funds for donation.

What Are My Options?

The settlement notice explains that you have two main options:

Do nothing
If the court grants final approval, you will automatically receive your Settlement Award and will be bound by the final judgment and the release of claims described in the settlement agreement. You give up the right to bring your own lawsuit about the same issues.
Object to the settlement
You can tell the court you do not like some part of the settlement. The court can either approve or reject the settlement as written. It cannot change the terms. To object, you must file a written objection with the court and mail copies to the lawyers for both sides by the December 10, 2025 objection deadline.

Your objection must include the case name and number, explain your reasons, attach any supporting documents, state whether you have a lawyer, and include your signature. You may hire your own lawyer at your own expense if you want one. Even if your objection does not follow every technical requirement, the court may still choose to consider it.

Who Represents the Settlement Class?

The court has appointed the law firm Rudolph Friedmann LLP as class counsel for settlement class members.

The court also appointed Dr. Gregory Katopodis, Alan Casso, David Carlson, and Kim Joyal as class representatives. They participated in discovery, mediation, and settlement negotiations on behalf of the class. If the settlement is approved, they will receive incentive awards for their work, subject to court approval.

Attorney Fees, Costs, and Other Payments

Under the settlement, class counsel will ask the court for:

• Attorney fees of up to 25 percent of the $4,175,000 Settlement Fund (up to $1,043,750)
• Reimbursement of out of pocket expenses of no more than $55,000
• Incentive awards for the five named plaintiffs, including reimbursement of expenses paid by Dr. Katopodis and a payment to the estate of Edward Petersen
• Administration costs of about $140,000 for Kroll Settlement Administration LLC

Any remaining funds, including uncashed payments, will be donated to Serious About Solutions Inc. if approved by the court, or another court approved recipient. If the parties cannot agree on a recipient and Serious About Solutions is not approved, residual funds will be directed to the Massachusetts IOLTA Committee.
