What Changed Recently?

The claim window opened after the court preliminarily approved a $9,350,000 cash settlement of Leone v. ASP Isotopes Inc., No. 1:24-cv-9253-CM, pending in the U.S. District Court for the Southern District of New York before Judge Colleen McMahon. According to the company's quarterly report to the SEC, the parties reached an agreement in principle at mediation on April 3, 2026, lead plaintiff moved for preliminary approval on July 7, 2026, and the court granted that motion on July 9, 2026 and set the December 15 hearing.

The lawsuit was first filed in December 2024. It alleges that ASP Isotopes and its executives made statements that left investors with the impression the company was actively carrying out uranium isotope separation and enrichment work, and that those statements were false or misleading. Plaintiffs allege the stock traded at inflated prices as a result and fell when the alleged truth was disclosed. On December 4, 2025, the court denied the defendants' motion to dismiss in part and certified a class of investors. Defendants deny the allegations and any wrongdoing, and the case settled before any court ruled on whether the statements were in fact misleading.

Who Qualifies?

The settlement class covers all persons and entities who purchased the publicly traded common stock of ASP Isotopes Inc. between September 26, 2024 and November 26, 2024, both dates inclusive, and who were damaged as a result. ASP Isotopes common stock trades on the Nasdaq under the ticker ASPI.

Excluded are the defendants — ASP Isotopes and its chief executive officer, Paul E. Mann — along with the company's officers and directors, members of their immediate families, entities they control, trusts associated with Mr. Mann, and anyone who submits a valid request for exclusion. Receiving a notice does not by itself make someone a class member; eligibility depends on what was actually bought and when.

How Much Can You Get?

The $9,350,000 settlement amount pays notice and administration costs, any attorneys' fees and litigation expenses the court awards, and taxes on the fund before anything is distributed. Lead counsel intends to ask for fees of up to 33⅓% of the settlement fund and expenses of up to $305,000, which includes up to $15,000 to reimburse the lead plaintiff's own costs. Those requests work out to about $0.14 per affected share. The court has not ruled on them.

Plaintiffs estimate the average recovery at about $0.38 per affected share before fees and expenses. That is an estimate and an average, not a per-claimant promise. Each authorized claimant receives a pro rata share of the net settlement fund based on their Recognized Loss under the plan of allocation, measured against the total Recognized Losses of everyone who files an acceptable claim. When shares were bought and whether and when they were sold determine the Recognized Loss, so individual payments can be higher or lower than the average.

No payment is issued to a claimant whose pro rata share would come to less than $10.

What Proof or Notice ID Is Required?

The claim form does not ask for a notice ID, claim number or other code from a mailed notice, so an investor who never received a notice can still file. It does require a valid email address and documentation of the ASP Isotopes transactions being claimed: brokerage account statements or trade confirmations showing the purchases, the sales, and the shares held at the relevant dates.

List every transaction the form asks about, including trades that made money. A claim missing transactions or records can be found deficient or rejected.

What Is the Deadline?

December 2, 2026. Online claims must be submitted by 11:59 p.m. Eastern Time on that date, and paper claims must be postmarked by December 2, 2026.

Requests for exclusion and objections to the settlement must be received by November 20, 2026. A class member who does nothing by that date stays in the class and is bound by the settlement if it is approved.

What Happens Next?

The court will consider whether to grant final approval of the settlement, the plan of allocation and lead counsel's request for fees and expenses at the hearing on December 15, 2026 at 12:30 p.m. The hearing date or format can change, and any change is posted on the official settlement website.

Payments cannot begin until the court approves the settlement, any appeals are resolved, and the administrator finishes reviewing claims. No distribution date has been announced.

No. Only purchases of ASP Isotopes publicly traded common stock made from September 26, 2024 through November 26, 2024 are covered.
