BuyAlerts Text Message Settlement Pays Up to $42.16 for Texts Sent After “Stop” or to Do Not Call Numbers

People who received more than one BuyAlerts marketing text within a 12-month period between January 1, 2022 and August 7, 2026, after replying “stop” or while their number was on the National Do Not Call Registry, may qualify to claim up to $42.16 from the BuyAlerts TCPA class action settlement. Claims are open through February 16, 2027.

Current Status

Claims are open. A claim must be submitted online or postmarked by 11:59 p.m. Eastern on February 16, 2027. The Miami-Dade County Circuit Court has preliminarily approved the settlement, and the final approval hearing is set for February 1, 2027. No payment date had been announced as of September 29, 2026; the notice says no payments will be made until the court approves the settlement and any appeals are final.

What Changed Recently?

Live Stream Technology Services, Inc., a Miami fintech company that does business as BuyAlerts, has agreed to make up to $3.6 million available to resolve claims that it sent marketing texts to people who had opted out or whose numbers were on the National Do Not Call Registry. Kroll Settlement Administration has opened the official settlement website and claim portal and is sending notices by email and postcard.



The plaintiffs allege the texts violated the federal Telephone Consumer Protection Act (TCPA) and, for Florida residents, the Florida Telephone Solicitation Act (FTSA). BuyAlerts denies all wrongdoing, and the court has not decided who is right.



Who Qualifies?

The court certified three overlapping settlement classes. All three cover texts about BuyAlerts’ own products or services sent to a cell phone between January 1, 2022 and August 7, 2026:


The settlement agreement puts the classes at about 85,373 people based on the parties’ records. An email or postcard notice means the recipient’s number was texted by BuyAlerts. Excluded are BuyAlerts and its affiliates, officers and employees, the presiding judges and their staff, the other released parties and their immediate families, and plaintiffs’ counsel.



How Much Can You Get?

Each class member who files a valid claim receives up to $42.16. It is a flat amount: fitting into more than one class or receiving more texts does not increase it, and each person may file only one claim.



The $3.6 million is a cap, not a pool that gets divided up. It also has to cover class counsel’s requested fees of one-third of the fund ($1,199,880), service awards of up to $5,000 for each of the two class representatives, and notice and administration costs capped at $120,000. If valid claims plus those amounts would exceed the cap, every payment is reduced by the same percentage. Money left over after payments goes back to BuyAlerts, as does the value of any uncashed checks.



What Proof or Notice ID Is Required?

The online claim form opens with a Unique ID printed on the email or postcard notice. The claim then asks for a name, address, every phone number that received BuyAlerts texts and a contact number. The claimant must attest under penalty of perjury to being the subscriber or authorized user of those numbers and to having received more than one BuyAlerts text after opting out or while on the Do Not Call Registry. No screenshots or phone bills are requested; the administrator checks the listed numbers against BuyAlerts’ records.



What Is the Deadline?

Claims must be submitted online or postmarked by 11:59 p.m. Eastern on February 16, 2027. Exclusion requests and objections are due January 4, 2027.



How Do You Take Action?

File on the official BuyAlerts TCPA settlement website using the Claim Form link and the Unique ID from the notice. A printable Claim Form is also posted on the website, and the postcard notice includes a detachable form that can be mailed back.



Class members who want to keep the right to sue BuyAlerts on their own must mail a signed exclusion request, postmarked by January 4, 2027, that lists the phone numbers that received the texts. Exclusions cannot be made by phone, fax or email, and mass exclusions are not allowed. Objections must be filed with the court and mailed to the administrator by the same date. The official website lists exactly what each request must include.



What Happens Next?

Judge Robert T. Watson will hold the final approval hearing by Zoom at 9:00 a.m. Eastern on February 1, 2027, and will consider the fee and service-award requests at the same time. The date can change by court order, and any change will be posted on the settlement website. Under the settlement agreement, checks go out within 45 days after the settlement becomes final, meaning after final approval and after any appeals are resolved.

Questions

Can I file more than one claim if BuyAlerts texted several of my numbers?

No. Each class member may submit one Claim Form, no matter how many texts arrived. The form lets a claimant list every phone number that received BuyAlerts texts, and the administrator checks the messages against those numbers.

Does the number of texts I received change my payment?

No. The payment is a flat amount of up to $42.16 per class member, whether someone received two texts or many more. The only thing that can change it is a uniform pro rata reduction if valid claims plus fees and costs would exceed the $3.6 million cap.

What if I never got an email or postcard from the administrator?

Notices went to people whose numbers appear in BuyAlerts’ texting records, and the online claim form asks for the Unique ID printed on that notice. Someone who believes they qualify but has no notice can use the Contact Us page on the official settlement website to ask about their status before the February 16, 2027 deadline.

Is there a deadline to cash the settlement check?

Yes. Under the settlement agreement, checks are valid for 90 days from the date printed on them. Uncashed checks are voided, and that money goes back to BuyAlerts rather than to other class members.
