What Is This Settlement About?
If you or your business purchased or leased a Toyota forklift with an internal combustion (IC) engine that was built between 2007 and 2021, you could be entitled to approximately $1,000 to $2,500 per forklift, plus a free service plan visit — from a $299.5 million class action settlement.
The lawsuit alleged that Toyota Material Handling, Toyota Material Handling Inc., and Toyota Industries Corporation engaged in improper conduct related to emissions certification for certain Toyota IC forklifts sold in the United States. Toyota disputes these allegations, and the court has not decided who is right. Both sides agreed to settle to avoid the risk and cost of further litigation.
The settlement covers an estimated hundreds of thousands of Toyota IC forklifts across the country. The $299.5 million cash fund is non-reversionary, meaning none of it goes back to Toyota — every dollar is distributed to class members, attorneys, and administration.
Which Toyota Forklifts Are Covered?
A "Settlement Class Forklift" is any Toyota forklift with an internal combustion engine built between 2007 and 2021 and sold in the United States. Specifically, this includes Toyota forklifts sold with any of the following engines and emissions certification years:
If your forklift has one of these engines and was originally sold or leased in the United States, it is a covered Settlement Class Forklift.
Do I Qualify?
You qualify if you purchased or leased a Settlement Class Forklift on or before January 20, 2026. This applies to businesses, individuals, and any other entity that owned or leased a qualifying Toyota IC forklift. Multiple claims can be filed if you own or have owned multiple eligible forklifts.
You do not qualify if you are a Toyota officer, director, employee, authorized dealer/distributor (or their employees), or if you opted out of the settlement.
What Benefits Are Available?
The settlement provides three categories of benefits:
Cash Payment ($299.5 Million Fund): Class members who submit a valid claim form will receive a cash payment for each eligible forklift. The per-forklift payment is estimated at approximately $1,000 to $2,500, depending on the number of valid claims submitted and court-approved deductions. If the court approves all requested fees, costs, and service awards, and if every eligible forklift were claimed (which is unlikely), the minimum per-forklift payment would be approximately $820. Your payment amount also depends on whether other class members file claims for the same forklift — the original purchaser receives 60% of the amount allocated to that forklift, with the remaining 40% split among other claimants (subsequent owners or lessees).
Free Service Plan Visit: Each operable Settlement Class Forklift in the United States qualifies for one free service plan visit. During this visit, a certified technician from an authorized Toyota Material Handling dealership will travel to your location and perform a full inspection of the forklift's major systems based on the recommended maintenance outlined in the service manuals. The visit includes lubrication, cleaning, measuring, and re-tightening, plus your choice of an oil change or a transmission fluid change. You have three years from the settlement's effective date to schedule your visit (estimated deadline: August 8, 2029). New Parts Warranty: If Toyota issues a government-approved or government-authorized recall for the Settlement Class Engines by October 31, 2028, all new engine parts installed during that recall will be covered by a New Parts Warranty. Both the service plan visit eligibility and the New Parts Warranty transfer with the forklift if it is sold.
How Do I File a Claim?
You must submit a Settlement Claim Form by September 22, 2026. Claims can be filed online at the settlement website or downloaded and mailed to the settlement administrator. You may be asked to provide supporting documents such as proof of ownership or lease.
After submission, the settlement administrator will review your claim. If anything is missing or incomplete, they will contact you and allow 30 days to provide the missing information. Payments will be sent after the settlement's effective date, which is expected in late 2026 at the earliest.

What Happens If I Do Nothing?
If you do nothing, you will not receive a cash payment. However, you will still be bound by the settlement and give up your right to sue Toyota over the same claims. You would still be eligible to schedule a free service plan visit and receive the New Parts Warranty if a recall is issued. To get the cash payment, you must file a claim by September 22, 2026.
