What Is the Settlement About?

Alexander Floyd, who applied for a job at the cloud security company Wiz, Inc., sued on March 21, 2025 in King County Superior Court in Seattle. The case, Floyd v. Wiz, Inc., No. 25-2-09082-5 SEA, alleged that Wiz’s job postings for Washington positions did not include the wage scale or salary range, or a general description of benefits, as Washington’s Equal Pay and Opportunities Act (RCW 49.58.110) has required since January 1, 2023.

Wiz denies that it violated the law and says the claims have no merit; the settlement is not an admission of wrongdoing. The parties settled after limited discovery. The $5 million fund is a “policy limits” settlement, paid through Wiz’s employment practices liability insurance, and the settlement agreement says the amount was set at the policy’s $5 million limit. The court preliminarily approved it on September 24, 2026. The case joins a long line of Washington job-posting settlements; OCA tracks them on its Washington job posting settlements page.

Who Qualifies?

The settlement class is the plaintiff and everyone who, from January 1, 2023 through September 24, 2026, applied for a job opening in Washington with Wiz, Inc. where the posting did not disclose a wage scale or salary range, and/or a general description of benefits and other compensation. Wiz told the parties there are 4,003 class members. Class members are identified from Wiz’s own application records, and people on the list were sent a notice by mail and email.

Someone who believes they applied but was left off the list could dispute it within 30 days of the notice mailing. Under the agreement, Wiz’s records control unless the person shows documents proving they should have been included.

How Much Can You Get?

Every class member who does not opt out gets an equal share of the class fund. The fund is the $5,000,000 total minus attorneys’ fees of $1,666,666.67 (about one-third), up to $10,000 in costs, a $25,000 service award to the plaintiff, and up to $50,000 in administration costs, all subject to the court’s approval. If those amounts are approved in full, about $3.25 million would remain, or roughly $811 per person divided among 4,003 class members. That figure is OpenClassActions.com’s estimate from the settlement terms; the notice mailed to each class member lists that person’s own estimated amount. Shares of anyone who opts out go back into the class fund for everyone else, so opt-outs would raise the per-person amount.

Payments are treated as non-wage damages reported on a Form 1099, according to the notice. Checks expire 180 days after they are issued. Uncashed money is sent to Washington’s unclaimed property program in the class member’s name, and any other leftover funds go to the Legal Foundation of Washington.

Is Proof Required?

No. There is no claim form, and nothing has to be submitted to be paid. The LoginID and PIN printed on the notice are used only to log in on the settlement website to update a mailing address or switch from a paper check to a digital payment such as PayPal or Venmo. Class members can also return the address form that came with the notice. The administrator can resend a LoginID and PIN to class members who request them with their full name and mailing address.

What Are the Deadlines?

November 23, 2026 is the deadline to: The full requirements for opt-outs and objections are in the notice and on the official settlement website.

Tinker will hold the final approval hearing on January 22, 2027 at 9:00 a.m. in King County Superior Court in Seattle, with remote attendance by Zoom available; the link is posted on the settlement website. Wiz can void the settlement if more than 10% of the class opts out. Questions

Do I need to file a claim in the Wiz settlement?

No. There is no claim form. Class members identified from Wiz's application records who do not exclude themselves will be paid automatically if the court grants final approval. The administrator needs a current mailing address, or a digital payment selection, to send the payment.

How much will each Wiz job applicant get?

Every class member gets an equal share. OpenClassActions.com estimates about $811 each: the $5 million fund minus the requested $1,666,666.67 in attorneys' fees, up to $10,000 in costs, a $25,000 service award and up to $50,000 in administration costs, divided among the 4,003 class members Wiz reported. The actual amount depends on what the court approves and how many people opt out; each notice lists that person's estimated payment.

What is the Washington job posting pay law?

Washington's Equal Pay and Opportunities Act, RCW 49.58.110, has required employers since January 1, 2023 to include the wage scale or salary range and a general description of benefits and other compensation in job postings for Washington positions. Applicants can bring claims when a posting leaves that information out.

Do I need my LoginID and PIN?

Only to update a mailing address or choose a digital payment online. The LoginID and PIN printed on the notice open that form on the settlement website; they are not needed to be paid. The address form that came with the notice can be used instead, and the administrator can resend the LoginID and PIN on request.

When will Wiz settlement payments be made?

Not before final approval. The final approval hearing is January 22, 2027. Under the settlement schedule, payments go out about 14 days after the fund is paid, which is about 30 days after the settlement becomes effective, which in turn is about 31 days after a final approval order if there is no appeal. Checks expire 180 days after they are issued.
