You may be part of a proposed nationwide settlement with Zale Delaware, Inc. d/b/a Zales Jewelers
related to text messages allegedly sent to numbers listed on the National Do Not Call Registry without
consent under the Telephone Consumer Protection Act. Zales denies all allegations. The settlement provides
cash payments to eligible consumers who submit valid claims.
What is the Total Settlement Amount?
A Settlement Sum of $7,548,300 has been established. This will pay approved claims, notice and
administration costs, any service award, and any court-approved attorneys’ fees and expenses.
Who Is Included?
All persons in the United States who did not provide their number to Zales and to whom Zales delivered, or
caused to be delivered, more than one telemarketing text within a 12 month period while the number had been
on the National Do Not Call Registry for at least 30 days. Class period is October 15, 2020 through
the date of preliminary approval.
How Much Can I Get Paid?
Class Members with approved claims will receive up to $100 each, less a proportional share of fees
and costs. Only one claim per phone number will be paid. Payments will be made by check.

What is the TCPA?
The Telephone Consumer Protection Act is a federal law that restricts telemarketing calls and text messages
to protect consumer privacy. In general, companies must have prior express consent before sending
marketing texts to your cell phone, and they must honor the National Do Not Call Registry.
The TCPA also limits the use of automated dialing and prerecorded messages for marketing. Consumers can
revoke consent at any time by using a reasonable method, like replying “STOP.”
If a company violates the TCPA, consumers may seek statutory damages in court. The law allows up to $500 per
call or text, or up to $1,500 per call or text if the violation is found to be willful or knowing. This
Zales case alleges marketing texts were sent to numbers on the Do Not Call Registry without proper consent;
Zales denies wrongdoing.

Payments will be issued after the Court grants final approval and any appeals are resolved. Please be

How Do I Know if I am in the Class?
You may have received a postcard or email notice if your number appears in the call records. If you did not
