This article describes a class action complaint. The statements below are unproven allegations. Home Genius Exteriors has not been found liable, there is no certified class, and nothing to claim at this time. This page is informational and is not legal advice.

What Is This About?

A proposed class action filed on October 30, 2026 alleges that CWPOH, Inc., which does business as Home Genius Exteriors, made telemarketing calls and sent marketing texts to people on the National Do Not Call Registry without their consent. The case, Scofield v. CWPOH, Inc., No. 5:26-cv-08324, is in the U.S. District Court for the Eastern District of Pennsylvania and is assigned to Judge Jeffrey L. Schmehl. Home Genius Exteriors sells roofing, windows and other home remodeling work and has offices in Allentown and Coatesville, Pennsylvania.

The plaintiff says his cell phone number has been on the Do Not Call Registry since 2004 and that he was never a Home Genius Exteriors customer. He alleges that he received at least five texts and four calls from the company between June 14 and September 18, 2026, many of them saying he had asked online about roof work, which he says he never did. Home Genius Exteriors has not yet responded in court.

What Does the Complaint Allege?

According to the complaint, the first texts on June 14, 2026 offered roofing help and free attic insulation with a new roof, and a text two days later offered a free home inspection. The plaintiff says that when a Home Genius Exteriors caller phoned later that day about an “online request” for roof work, he told the caller to stop calling, and that a second caller phoned again the same day. He says he set up an estimate appointment to learn who was calling him and asked the representative who came to his home to put him on the company’s internal do-not-call list.

The complaint alleges that the calls continued anyway, on July 6 and again on September 18, 2026, when a caller offered estimates for bathroom, kitchen, window, roofing, heating and cooling, and flooring work and transferred him to a Home Genius Exteriors representative. It also alleges that the numbers the company called and texted from could not be called back or texted during business hours to make a do-not-call request, and that the September 18 call displayed a caller ID name unrelated to the company.

What the TCPA Says

The Telephone Consumer Protection Act and the FCC’s rules bar telephone solicitations to residential numbers on the National Do Not Call Registry without the person’s consent, require companies that telemarket to keep an internal do-not-call list and honor requests to stop, and require telemarketers to transmit caller ID information, including a number that can take a do-not-call request during regular business hours. The law lets people sue for up to $500 per violating call, and a court can increase that to up to $1,500 if the violations were willful or knowing.

Who Could Be Covered?

The complaint proposes three nationwide classes, each covering the four years before October 30, 2026: The complaint estimates that the classes include at least hundreds of people. Calls made by third parties on Home Genius Exteriors’ behalf are included. The company, its agents and employees, and the judge and court staff are excluded.

What Happens Next?

Home Genius Exteriors will have a chance to respond to the complaint. The plaintiff, represented by Perrong Law LLC, would later have to ask the court to certify a class. If the case settles or the plaintiff wins after certification, class members would be notified, and OpenClassActions.com will cover it.
