Why the Payment Is $68.81, Not $90
The settlement notice described a one-time cash payment of up to $90 for each class member who submitted a valid, timely claim form. That $90 was a ceiling. Every claimant receives an equal share of the Net Settlement Fund — the $21.5 million left after the court-approved attorneys’ fees and costs, the class representatives’ service awards and the cost of running the settlement — so the final figure depended on how many valid claims came in.The administrator’s FAQ now says that, because of the number of eligible claims, the payment came in below the estimated $90 and that $68.81 is each claimant’s share. How the Money Is Being Paid
Each claimant is paid by the method chosen on the claim form: a paper check or an electronic option such as PayPal, Venmo or Zelle. KTLA reported in late August that some Californians were surprised to find the $68 payments, and a $68.81 check or deposit tied to the Sutter Health Analytics Litigation settlement is this distribution.Two dates matter now:
- Digital payments are available to collect through October 4, 2026, according to the official FAQ. A digital payment usually arrives as an email with a link to accept it, so check spam and promotions folders for the address listed on the claim.
- All checks expire and become void 180 days after they are issued. A check that is lost, expired or damaged is handled through the administrator; OCA’s explainer on reissued settlement checks covers how that process usually works.
Questions about a specific payment go to the administrator, Epiq, through the contact page on the official Sutter Health Analytics settlement website. Never share banking details with anyone who reaches out unprompted claiming to represent the settlement.
Who Was in the Class
The settlement class covers people who were California residents when they logged into their Sutter Health My Health Online patient portal account, for purposes relating to their own healthcare, at any time from June 10, 2015 through March 20, 2020. Being in the class was not enough to be paid: only class members who filed a valid claim by the May 5, 2026 deadline are receiving a payment.What the Lawsuit Alleged
The case, Jane Doe I and Jane Doe II, et al. v. Sutter Health, Case No. 34-2019-00258072-CU-BT-GDS, was filed on June 10, 2019 in Sacramento County Superior Court. The plaintiffs alleged that tracking, analytics and advertising technologies on certain Sutter Health webpages, including the My Health Online portal login page, disclosed patients’ personally identifiable and health information to third parties such as Facebook and Google. They brought claims under the California Invasion of Privacy Act and for breach of express and implied contract.Sutter Health denies the claims. According to the settlement notice, it denies that any patient information or protected health information was shared with unauthorized third parties, denies any violation or breach, and maintains that it did nothing wrong. The $21.5 million settlement resolves the case without any finding that Sutter Health violated the law.
The case is one of many brought against hospital systems over website tracking tools. MarinHealth Medical Center’s $3 million settlement, another California case, paid claimants roughly $111 each earlier this year, as covered in OCA’s MarinHealth payout report.
Not the Sutter Health Premium Case
A separate case, Sidibe v. Sutter Health, is an antitrust case over health plan premiums and has its own settlement website and process. The $68.81 payments described here come only from the Sutter Health Analytics privacy settlement; receiving one says nothing about eligibility in the premium case, and the reverse is also true.Questions
Why is the Sutter Health payment $68.81 instead of $90?
The $90 figure was a cap, not a promise. Each valid claimant receives an equal pro rata share of the Net Settlement Fund, the money left after court-approved attorneys’ fees, service awards and administration costs. The settlement administrator says the number of eligible claims brought each share down to $68.81.
Can I still file a claim in the Sutter Health Analytics settlement?
No. The claim deadline was May 5, 2026, and the official claim page now shows that claims are closed. The printed notice showed April 28, 2026, a date based on a projected judgment date; because judgment was entered March 6, 2026, the settlement’s 60-day rule set the actual deadline at May 5. Only class members who submitted a valid, timely claim form are being paid.
What if I chose a digital payment and have not collected it?
According to the official FAQ, digital payments can be collected through October 4, 2026. Claimants who picked PayPal, Venmo, Zelle or another electronic option should look for the payment notice sent to the email address on their claim, including spam and promotions folders, and use the official settlement website’s contact page for anything missing.

Is this the same as the Sutter Health premium lawsuit?
