Yes, this settlement was completed. The PDF circulating online is the agreement the parties signed in late April 2025, before the court filled in the dates and approved the deal. It is an important document, but it is not the last event in the case.
The Nevada court gave the settlement preliminary approval on June 4, 2025. Class members then had until September 22, 2025 to file a claim, opt out, or object. Judge Jennifer Schwartz granted final approval on September 30, 2025 and dismissed the Nevada action with prejudice. According to the court-authorized settlement website, benefit distribution to timely, valid claimants began on January 21, 2026.
That means there is no claim form to file now. Anyone who submitted a timely claim and has a payment question should contact the settlement administrator at info@LifeMDSettlement.com. People who did not file by the deadline cannot submit a new claim through Open Class Actions or any other third-party website.

What the Lawsuit Alleged
The lawsuit alleged that LifeMD, which also does business as RexMD, placed tracking technologies on its websites and potentially transmitted identifiable health information and other private information to third parties including Meta, Google, and TikTok. The complaint said visitors used the sites to explore or purchase treatment for sensitive conditions, making the alleged disclosures especially private.
The plaintiffs brought claims that included alleged violations of the federal Electronic Communications Privacy Act and Nevada privacy law, along with negligence, invasion of privacy, breach of confidence, and unjust enrichment theories. Those were allegations, not findings. LifeMD denied that it did anything wrong or that protected information was actually disclosed, and the court did not decide liability.
The settlement class described in the notice generally covered U.S. residents who were or had been LifeMD or RexMD members, or who ordered or purchased products from the companies, and whose private information was allegedly disclosed through tracking tools on the websites. The final approval order certified the class only to carry out the settlement.
What Class Members Could Receive
A class member who submitted a valid claim by September 22, 2025 could choose one of two benefits:
• $10 in cash, delivered electronically or by check; or
• a $25 voucher for LifeMD or RexMD products or services, valid for two years.
The settlement agreement says there was no aggregate cap on class-member benefits. This was therefore not a traditional fixed common fund that every claimant divided pro rata. LifeMD also agreed to use a third-party consent service to enhance consent management on its website for at least two years after the settlement became effective.
The court awarded class counsel $750,000 in attorneys' fees and expenses and awarded each of the two class representatives $2,500. The notice said those amounts would be paid separately from class-member benefits. LifeMD later reported approximately $1.1 million as its estimated settlement liability in its quarterly filing; that accounting estimate should not be confused with a fixed $1.1 million cash fund for claimants.
Why the Federal Docket Says the Case Was Dismissed
The case took an unusual-looking but documented route through two courts. Matthew Marden first filed the action in the Southern District of New York on August 23, 2023. An amended complaint followed, LifeMD moved to dismiss it in March 2024, and the parties attended mediation in July 2024.
On November 1, 2024, the plaintiffs voluntarily dismissed the federal case without prejudice. That phrase matters: it allowed them to bring the claims again. They did so on November 25, 2024 in the District Court of Clark County, Nevada, under the caption W.M.F. & Matthew Marden v. LifeMD, Inc., Case No. A-24-906800-C.
The Nevada case is the one that settled. After final approval, that action was dismissed with prejudice, meaning the released claims were resolved for class members who did not opt out. The final order records no objections and five timely opt-outs.
