What's This Settlement About?

A $10 Million lawsuit has been settlement involving large pharmaceutical companies Bristol-Myers Squibb and Gilead on behalf of defendants. The class action lawsuit claims that Gilead Sciences, Inc., engaged in a variety of allegedly anticompetitive conduct that caused certain consumers and third-party payors to pay too much for HIV medicines, specifically: Atripla, Biktarvy, Complera, Descovy, Evotaz, Genvoya, Odefsey, Prezcobix, Stribild, Symtuza, Truvada, and Viread. “BMS Payment” should pay Ten Million Dollars.

How Do I Qualify For Payment?

You are included in the Atripla Settlement Damages Class if you reside in the United States or its territories and you purchased, paid, and/or provided reimbursement in (which shall include, with respect to TPPs(**Third-Party Payors**), the state in which you have your principal place of business), for consumption by yourself or your family, or, with respect to TPPs, by your members, employees, insureds, participants, citizens, residents, or beneficiaries, other than for resale, during the period May 14, 2015, through and until October 13, 2021.

You are included in the Evotaz Settlement Damages Class if you reside in the United States or its territories and you purchased, paid, and/or provided reimbursement in (which shall include, with respect to TPPs, the state in which you have your principal place of business) any of the Damages States for some or all of the purchase price of Evotaz, for consumption by yourself or your family, or, with respect to TPPs, by your members, employees, insureds, participants, citizens, residents, or beneficiaries, other than for resale, during the period May 14, 2015, through and until October 13, 2021. The Evotaz Settlement Damages Class includes TPPs and individual consumers.

How Much Can I Get?

Evotaz purchasers or consumers will get a portion of $1.25 Million. The remainder will be distributed to purchasers of other medications involved in the suit. The amount of reimbursement will vary based on the amount of claims and content of class action members who file claims. You do not need to provide any documentation at this time. However, the Settlement Administrator may ask for additional proof supporting your claim. ?

How Do I File a Claim and Get Paid?

Any person residing in the United States or its territories who purchased and paid for some or all of the purchase price of branded or generic Atripla in Alabama, Arizona, Arkansas, California, Connecticut, District of Columbia, Florida, Hawaii, Idaho, Illinois, Iowa, Kansas, Maryland, Maine, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Montana, Nebraska, Nevada, New Hampshire, New Mexico, New York, North Carolina, North Dakota, Oregon, Rhode Island, South Dakota, Tennessee, Utah, Vermont, West Virginia, or Wisconsin for the purpose of consumption by yourself or your family members at any time between May 14, 2015 through and until October 13, 2021.

Additionally, a person residing in the United States or its territories who purchased and paid for some or all of the purchase price of Evotaz in any of the Damages States listed above for the purpose of consumption by yourself or your family member at any time between May 14, 2015 through and until October 13, 2021. To be eligible for payment you must submit a valid claim under 'File Consumer Claim' HERE. You do not need to provide any documentation at this time. However, the Settlement Administrator may ask for additional proof supporting your claim.
