The case is captioned Julie Roberts, et al. v. The Charlotte-Mecklenburg Hospital Authority, Case No. 25CV057073-590, pending in the Superior Court of Mecklenburg County, North Carolina.
Plaintiffs allege that Atrium Health used pixel technology on its website and, for a limited time between January 1, 2015 and July 31, 2019, in its MyAtriumHealth and MyCarolinas patient portal, and that this led to the disclosure of personal and health-related information to third parties including Meta (formerly Facebook) and Google. The lawsuit alleges this invaded the privacy of patients and portal users. Atrium Health denies that its use of the technology is the basis for any claims.
To resolve the claims, Atrium Health agreed to the settlement to avoid the costs and risks of continued litigation. The settlement is not an admission of wrongdoing, and the Court has not decided in favor of either side. Who Is Atrium Health?
Atrium Health is the brand name of The Charlotte-Mecklenburg Hospital Authority, a large not-for-profit health care system based in Charlotte, North Carolina, and part of Advocate Health. Patients interact with the system online through the MyAtriumHealth and MyCarolinas patient portals, which patients use to schedule appointments, view test results, message providers, request prescription refills, and access medical records. Those patient portals, and Atrium Health's website, are at the center of this lawsuit over the tracking technologies the suit alleges were used on them.
Who Qualifies for the Atrium Health Settlement?
The Settlement Class consists of all individuals residing in the United States who had a MyAtriumHealth or MyCarolinas patient portal account between January 1, 2015 and April 10, 2024.
Excluded from the class are Atrium Health, any entity in which it has a controlling interest, and its affiliates, parents, subsidiaries, officers, directors, legal representatives, successors, and assigns; any judge or judicial officer presiding over the case, along with their immediate families and judicial staff; and any individual who timely and validly excludes themselves from the settlement. You received a notice because Atrium Health's records indicate you had a portal account during the class period.
How Much Can You Get From the Atrium Health Settlement?
If the Court approves it, Atrium Health will pay up to $1,800,000 to resolve the lawsuit. The benefit you can receive depends on which of two groups you fall into, and you cannot receive payments from both:
• Group 1 covers Class Members who submit a valid Claim Form attesting that they accessed or used their patient portal account between January 1, 2015 and July 31, 2019 (subject to confirmation against Atrium Health's records). After Class Representative service awards, Class Counsel's attorneys' fees and expenses, and Group 1 administration costs are deducted, the balance of the $1,500,000 Settlement Fund is distributed pro rata (in equal shares) to valid Group 1 claimants.
• Group 2 covers Class Members who had a portal account between January 1, 2015 and April 10, 2024 but did not access it during the Group 1 window. Group 2 claimants can receive a payment of up to $10 (subject to confirmation against Atrium Health's records). The final amount may be a pro rata share of a separate $300,000, depending on how many valid Group 2 claims are filed.
Because both groups are paid pro rata, there is no guaranteed fixed amount per person — the individual payment depends on how many valid claims are filed in each group. The settlement administrator calculates each approved payment after the claim period closes and the settlement becomes final.
Class Counsel will ask the Court to approve attorneys' fees of up to $500,000 plus expenses not to exceed $25,000, and service award payments of $2,500 to each of the Class Representatives. If approved, these amounts are paid from the Settlement Fund before Group 1 payments are made.
Do I Need Proof to File?
Yes. To file online you must enter the Class Member ID printed on the postcard or email notice you received, and check the box certifying that you had a MyAtriumHealth or MyCarolinas patient portal account between January 1, 2015 and April 10, 2024. That administrator-issued Class Member ID is your proof of class membership. If you did not receive a notice but believe you are a Settlement Class Member, you can request a paper Claim Form or help through the official settlement website.

You are not required to attend the Final Approval Hearing.
