What Is the Memorial Health MyChart Pixel Settlement About?

Memorial Health Services has agreed to a class action settlement to resolve claims that it disclosed its patients' personally identifiable information (PII) to third parties through the Meta Pixel and other tracking, analytics, and advertising technologies without consent. The case is captioned Valladolid v. Memorial Health Services, Case No. 23STCV05059, pending in the Superior Court of the State of California, County of Los Angeles.

The lawsuit alleges that this disclosure violated the California Invasion of Privacy Act, Cal. Pen. Code § 631(a). Who Is Memorial Health Services?

Memorial Health Services (MHS) is a not-for-profit health care system based in Southern California. Patients interact with the system online through the Memorial Health Services MyChart patient portal — the web-based portal built on Epic's MyChart platform — which patients use to schedule appointments, view test results, message providers, request prescription refills, and access medical records. Each Settlement Class Member who files a valid Claim Form will receive a cash payment — a pro rata share of the net settlement fund. Because payments are pro rata, there is no fixed dollar amount per person: the more valid claims filed, the smaller each individual share, and vice versa. In addition to the class payments, Memorial has agreed to pay the costs of notice and administration, court-approved attorneys' fees and costs to Class Counsel (Class Counsel may seek no more than $250,000), and an incentive award to the class representative (up to $2,500, subject to court approval).
