The lawsuit, Habberfield v. Boohoo.com USA, Inc., alleged that Boohoo, BoohooMAN, PrettyLittleThing, and
Nasty Gal advertised inflated reference prices and constant discounts that could mislead shoppers into
believing they were getting larger bargains than they really were. The defendants denied all wrongdoing.
The settlement resolved the dispute by providing automatic gift card benefits to eligible customers in the
United States outside California who did not opt out.
You were in the Settlement Class if you purchased outside California from one or more of these brands
during the class periods:
• Boohoo or BoohooMAN from April 1, 2016 through June 17, 2022
• PrettyLittleThing from April 1, 2016 through June 17, 2022
• Nasty Gal from February 28, 2017 through June 17, 2022
California purchases were excluded. Additional standard exclusions applied.
Settlement Class Members who did not opt out automatically received one $10 gift card per eligible brand
from which they purchased during the class periods, up to three gift cards total. Cards are valid on the
U.S. websites of the issuing brand and include free shipping on the redemption purchase.
Key terms include no expiration, no minimum purchase, no blackout dates, no fees, transferability, and
with limited exceptions the ability to stack multiple cards.
No. There was never a claim form for this settlement — eligible class members automatically received
their $10 gift cards by email if they did not opt out. The settlement is now closed and distribution has
been completed.
If you believe you were eligible but never received a gift card, your only option is to contact the
settlement administrator through the official settlement website,
BoohooNationwidePricingSettlement.com, with your name, email
address, and order details from the class period. The administrator can verify whether a card was issued
to you, but new claims cannot be filed and late requests are generally not accepted after final
distribution.
The same fake-discount allegations are now being raised against another ultra-fast-fashion retailer — see
the Shein fake-discount pricing class action lawsuit.
The opt-out and objection deadline listed in the notice was September 15, 2023. The Final Approval Hearing
took place on November 2, 2023, in the U.S. District Court for the Central District of California, and
gift cards were emailed to eligible class members after final approval.
Who qualified for the Boohoo Nationwide Pricing Settlement?
All persons who purchased products outside California from Boohoo or BoohooMAN between April 1, 2016 and
June 17, 2022; PrettyLittleThing between April 1, 2016 and June 17, 2022; or Nasty Gal between
February 28, 2017 and June 17, 2022.
Did I need to submit a claim form?
No. There was never a claim form. Gift cards were automatic for Settlement Class Members who did not opt
out and were sent by email to the address on file with the retailer.
How much was the benefit?
One $10 gift card per eligible brand, up to three gift cards total if you purchased from Boohoo/BoohooMAN,
PrettyLittleThing, and Nasty Gal. Free shipping applied to the redemption purchase.
Can I still file a claim in the Boohoo pricing settlement?
No. The settlement is closed and distribution has been completed. Because the benefit was automatic, there
was never a claim form to file. If you believe you were eligible but never received a gift card, contact
the administrator through the official settlement website.
When was the Final Approval Hearing?
November 2, 2023, in the U.S. District Court for the Central District of California.
