Benworth Capital Data Breach Settlement: $50 Cash or Up to $5,000 in Losses

People who were sent notice of the May 2025 Benworth Capital Partners data incident may qualify to claim $50 with no documentation, or up to $5,000 in documented losses, from the Benworth data breach class action settlement. Filing online requires the Login ID and PIN printed on the notice. Claims are due December 21, 2026, and every class member also gets a year of credit monitoring automatically.

Current Status

Claims are open. The deadline to file online, or to postmark a paper claim, is December 21, 2026. The Circuit Court for Broward County, Florida has preliminarily approved the settlement and will hold a final approval hearing on January 5, 2027 at 8:45 a.m. Eastern. Cash payments and credit monitoring activation will follow only if the court grants final approval.

What Changed Recently?

Benworth Capital Partners LLC, a lender, agreed to settle a class action over a data incident on or about May 18, 2025, in which the settlement website says an unauthorized party accessed or acquired people’s names, addresses, Social Security numbers, telephone numbers and loan account information. The case is Arreola v. Benworth Capital Partners LLC, No. CACE-26-012064, in the Circuit Court for Broward County, Florida, before Judge Martin J. Bidwill.

Benworth denies that it did anything wrong, and the court has not decided who is right. The settlement agreement puts the class at more than 200,000 people.

Who Qualifies?

The class is every living individual residing in the United States who was sent notice by Benworth that their private information may have been affected in the data incident. Benworth and its officers and directors, government entities, and the judge assigned to the case and the judge’s immediate family and staff are excluded.

How Much Can You Get?

Each class member can claim one of two cash payments: Every class member also automatically receives one year of credit monitoring with one credit bureau, without filing a claim. Benworth pays the class lawyers separately; class counsel will ask for up to $750,000 in fees and costs and service awards of up to $2,000 for each class representative.

What Proof or Notice ID Is Required?

Filing online requires the Login ID and PIN printed on the notice Benworth’s settlement administrator sent to class members; the online claim form will not open without them. The printable paper claim form asks for the Login ID only “if known,” but class membership is still checked against the list of people who were sent notice, so the notice is effectively the key to filing either way. The credit monitoring activation code is printed on the same notice.

The $50 payment needs no documentation. Claims for documented losses need reasonable documentation; self-prepared documents such as handwritten receipts are not enough on their own.

What Is the Deadline?

Claims must be submitted online, or postmarked by mail, by December 21, 2026. The deadline to opt out or object is December 4, 2026.

How Do You Take Action?

Claims are filed through the official Benworth Data Settlement website, administered by Simpluris, using the Login ID and PIN from the notice. The site also posts the printable claim form, the long form notice, the settlement agreement and the preliminary approval order. Credit monitoring is activated after final approval using the code on the notice.

What Happens Next?

The court will hold a final approval hearing on January 5, 2027. If it approves the settlement, benefits will be provided after approval and any appeals. The settlement website does not give a payment date. OCA’s data breach hub lists other open data breach settlements.
