Riverside Resort & Casino Data Breach Settlement: $50 Cash ($75 in California) or Up to $3,000

Current Status

Claims are open. The deadline to file online, or to postmark a paper claim form, is January 4, 2027. The Circuit Court for Columbia County, Wisconsin has preliminarily approved the settlement and will hold a final approval hearing on January 27, 2027. Payments will be issued only if the court grants final approval and any appeals are resolved.

What Changed Recently?

Riverside Resort & Casino, Inc. and Riverside Resort & Casino, LLC agreed to settle a class action over a targeted cyberattack on Riverside’s computer systems in July 2024. The case is Dapello v. Riverside Resort & Casino, Inc., No. 2026CV000097, in the Circuit Court for Columbia County, Wisconsin, and the settlement website opened for claims with a January 4, 2027 deadline.

Riverside denies that it did anything wrong, and the court has not decided who is right.

Who Qualifies?

The court defined the class as all people residing in the United States who were sent notification that their private information was compromised because of the data incident Riverside discovered in or around July 2024. Riverside and its officers, directors and related companies, the lawyers for both sides, and the judge, the judge’s family and staff are excluded.

How Much Can You Get?

Every class member can claim one year of CyEx Financial Shield Total credit monitoring, which includes $1 million of financial fraud insurance. On top of that, each class member picks one of two cash routes: All cash benefits share an aggregate cap of $1,000,000. If the total value of claims exceeds that, every payment is reduced proportionally, so the flat payment may end up larger or smaller than $50 or $75. Riverside pays the class lawyers’ fees separately; class counsel will ask the court for $500,000 in fees and costs.

What Proof or Notice ID Is Required?

Filing online requires the Login ID and PIN printed on the notice Riverside’s settlement administrator sent to class members; the online claim form will not open without them. The printable paper claim form asks for the Login ID only “if known,” but class membership is still checked against the list of people who were sent notice, so the notice is effectively the key to filing either way.

The flat $50 or $75 payment and credit monitoring need no receipts or explanation. Claims for documented losses need proof such as bank statements or receipts; self-prepared notes can support other proof but are not enough alone. Lost time is claimed by selecting one, two or three hours on the form, with no receipts.

What Is the Deadline?

Online claims must be submitted by January 4, 2027, and paper claim forms, with any supporting documents, must be postmarked by January 4, 2027. The deadline to opt out or object is December 4, 2026.

How Do You Take Action?

Claims are filed through the official Riverside Data Incident Settlement website, administered by Simpluris, using the Login ID and PIN from the notice. The site also posts the printable claim form, the notice, the settlement agreement and the preliminary approval order.

What Happens Next?

The court will hold a final approval hearing on January 27, 2027. If it approves the settlement, payments will be distributed after any appeals are resolved. The settlement website does not give a payment date. OCA’s data breach hub lists other open data breach settlements.

No. The $50 alternative cash payment ($75 for California residents) is instead of the other cash options. Could the Riverside payment be smaller than $50?

Yes. Benefits are capped at $1,000,000 in total. If claims add up to more than that, every payment is reduced proportionally, and the settlement website says the flat payment may be larger or smaller depending on the total claims filed.
