The lawsuit, Patel v. New York School of Interior Design, Index No. 156767/2026, is pending in the Supreme Court of the State of New York, New York County. It concerns a targeted cyberattack on the school’s computer systems in November 2023, in which, according to the settlement notice, files containing private information may have been accessed. NYSID denies that it did anything wrong, and the court has not decided who is right. The parties settled to avoid the cost and risk of further litigation, and the court preliminarily approved the settlement in an order filed September 14, 2026.
The settlement class is all individuals residing in the United States whose personally identifiable information was impacted in the data incident affecting NYSID in or around November 2023, including everyone who received notice of the incident. NYSID and its officers, directors and related companies, anyone who opts out, the judge and the judge’s family and staff, and anyone who carried out the attack are excluded.
According to the notice, the files involved may have contained Social Security numbers, driver’s license or state ID numbers, passport numbers, financial account and payment card information, health insurance and medical information, taxpayer ID numbers, student ID numbers and biometric information. The information varies by person.
Every class member can enroll in credit monitoring, and can choose either documented losses and lost time or a flat cash payment, but not both:
- Credit monitoring: three years of three-bureau credit monitoring with $1 million in fraud insurance.
- Ordinary losses, up to $500, with receipts or similar proof, for out-of-pocket costs from the incident such as credit reports, credit monitoring, credit freezes, replacement IDs and postage, incurred between November 2, 2023 and January 12, 2027.
- Lost time: up to four hours at $25 an hour, up to $100, which counts toward the $500 ordinary-loss cap.
- Extraordinary losses, up to $5,000, for documented money lost to identity theft or fraud that was more likely than not caused by the incident, where the person tried to prevent or recover the loss.
- Alternative cash payment of $50, instead of any of the cash options above, with no proof or explanation.
The notice does not describe an overall cap or pro rata reduction for these payments. Attorneys’ fees and costs of up to $265,000 and a $5,000 service award, if approved, are paid by NYSID separately.
The online claim form opens with the LoginID and PIN printed on the notice; the settlement administrator resends them to class members who ask with their full name and mailing address. A paper claim form can be downloaded from the settlement website and mailed instead. Loss claims need receipts or similar proof, and self-prepared notes alone are not enough. The $50 alternative payment needs no proof.
- January 12, 2027 — claim deadline, online or postmarked.
- December 28, 2026 — deadline to opt out, or to file an objection with the court.
- January 27, 2027 — final approval hearing at 9:30 a.m. Eastern in Room 418, 60 Centre Street, New York.
Claims are filed on the official NYSID Data Incident settlement website under Submit a Claim, using the LoginID and PIN from the notice, or by mailing the paper claim form postmarked by January 12, 2027.
The court will consider final approval at the January 27, 2027 hearing, along with class counsel’s request for fees and costs. If the settlement is approved, payments are distributed after any appeals are resolved. The court appointed Strauss Borrelli PLLC as class counsel. Simpluris runs the settlement website.
