Infiniti of Clarendon Hills is a luxury car dealership located at 415 E. Ogden Avenue in Clarendon Hills, Illinois, a suburb of Chicago. The dealership sells new and pre-owned Infiniti vehicles including sedans, crossovers, and SUVs. It also provides automotive service and financing. The dealership is part of the Lisle Auto Plaza group and has been operating since 1989, making it one of the original Infiniti dealers in the United States.
The lawsuit centers on how the dealership marketed its vehicles. According to the complaint, after consumers submitted their contact information through Kelley Blue Book (KBB), Infiniti sent them repeated text messages and calls promoting its products and services. Many of these consumers had their phone numbers registered on the National Do Not Call Registry, which is supposed to stop companies from contacting them with unsolicited marketing. The TCPA makes it illegal to send more than one telemarketing message within a 12-month period to a number on the Do Not Call Registry.
What is the Total Settlement Amount?
Infiniti has agreed to pay up to $552,600.00 into a common settlement fund. After deducting attorney fees (up to 33%, not to exceed $182,358), litigation costs, administration expenses, and a service award to the class representative (up to $5,000), the remaining funds will be distributed equally among class members who file valid claims.
Who Qualifies for the Infiniti TCPA Settlement?
You are in the settlement class if all of the following are true. You submitted your consumer lead information to Kelley Blue Book. You received more than one text message or call from Infiniti of Clarendon Hills within any 12-month period. Your telephone number was listed on the National Do Not Call Registry for at least 30 days when the messages or calls were sent. The calls or texts were sent between February 6, 2021 and the date of preliminary approval (early 2026). The class includes all persons throughout the United States who meet these criteria.
If you received a notice via email or postcard from the settlement administrator, Infiniti's records indicate you were contacted on at least two occasions during the class period and you may be a class member.
How Much Money Will I Get?
Each class member who submits a timely and valid claim form will receive up to $150.00 per person. You only need to submit one claim form to receive payment for all text messages and calls you received from Infiniti during the class period.
If the settlement fund is not enough to pay $150.00 to every valid claimant, payments will be reduced on a pro rata (equal share) basis. If money remains in the fund after all payments are processed, the remainder will be returned to Infiniti.
How Do I File a Claim?
You can submit a claim form online at Infinititcpasettlement.com. You can also request a paper claim form by calling the settlement administrator. Fill out the form, sign it, and submit it online or mail it postmarked no later than May 23, 2026.
Is Proof Required to File a Claim?
No. If you received a claim form in the mail or by email, Infiniti's records already identify you as a class member. You only need to complete and submit the claim form by the deadline.

When Will Payments Be Sent?

What Happens If I Do Nothing?
If you do nothing, you will not receive a payment. Unless you exclude yourself, you will still give up your right to sue Infiniti of Clarendon Hills over the same telemarketing claims covered by this settlement.
Can I Opt Out of the Infiniti Settlement?
Yes. The deadline to opt out is March 24, 2026. You must mail a signed letter stating that you wish to be excluded from the settlement. Include your name, address, telephone number, and a statement that you wish to be excluded. Mail it postmarked by March 24, 2026 to the settlement administrator. If you opt out, you will not receive any payment but you keep your right to sue Infiniti separately. You cannot exclude yourself by phone, fax, or email.
What is the Telephone Consumer Protection Act?
The Telephone Consumer Protection Act is a federal law that restricts telemarketing calls, auto-dialed calls, prerecorded calls, text messages, and unsolicited faxes. Under the TCPA, companies cannot send more than one telemarketing text message or call within a 12-month period to a phone number that has been on the National Do Not Call Registry for at least 30 days. The law provides for $500 in damages per violation and up to $1,500 per violation for willful or knowing violations.
What is the National Do Not Call Registry?
The National Do Not Call Registry is a free service run by the Federal Trade Commission that lets you register your home or cell phone number to reduce the number of telemarketing calls and texts you receive. Once your number has been on the registry for 31 days, most telemarketers are legally required to stop contacting you. You can register at donotcall.gov or by calling 1-888-382-1222 from the phone you want to register. Registration does not expire. If you are still getting unwanted calls or texts after registering, the company sending them may be violating the TCPA, which is exactly what this lawsuit alleges.
