If you ever used Knight Barry Title for a home purchase, refinance, or other real estate transaction, your personal information may have been stolen in a ransomware attack — and you could be entitled to up to $5,000 in cash, a pro rata settlement payment, and three years of free credit monitoring with $1 million in identity theft insurance.

Who Is Knight Barry Title?

If you've bought or sold a home in Wisconsin, Minnesota, Illinois, Indiana, or Michigan, there's a good chance Knight Barry Title handled some part of your transaction. Founded in 1918 and headquartered in Madison, Wisconsin, Knight Barry Title is one of the largest title insurance and real estate closing companies in the upper Midwest, operating roughly 80 offices across five states with more than 500 employees. They handle close to 120,000 real estate transactions per year.

When you close on a home, a title company like Knight Barry is the one sitting in the middle of the deal. They verify that the property's title is clean, issue title insurance policies that protect the buyer and lender, and manage the actual closing — collecting signatures, disbursing funds, and filing paperwork with the county.

That means Knight Barry holds an enormous amount of sensitive personal and financial data: Social Security numbers, bank account details, mortgage documents, driver's licenses, employment records, and everything else that goes into a real estate closing file. It's essentially a one-stop shop for identity thieves.

What Happened?

On or about August 15, 2023, Knight Barry Title was hit by a ransomware cyberattack that compromised its network and the personal identifying information of its clients. On or around February 1, 2024, the company sent notification letters to affected individuals informing them that their data may have been compromised.

A class action lawsuit was filed, and a settlement has now been reached. Knight Barry Title denies any wrongdoing, and no court has made any determination of liability. The case is In Re: Knight Barry Title, Inc. Data Incident Litigation, Case No. 2:24-cv-00211-LA, in the U.S. District Court for the Eastern District of Wisconsin, before Judge Lynn Adelman.

Why a Title Company Breach Is Especially Dangerous

Title companies don't just store your name and email address. They collect the full spectrum of personal and financial documents needed to complete a real estate transaction:

• Social Security numbers for every party on the transaction
• Bank account and routing numbers for wire transfers and escrow disbursements
• Mortgage application details including income, employment, and debt information
• Copies of government-issued photo IDs like driver's licenses and passports
• Property ownership and tax records
• Insurance policy information

This is exactly the kind of data that makes identity theft easy. With a complete real estate closing file, a criminal has everything they need to open new credit accounts, file fraudulent tax returns, take over existing bank accounts, or even attempt mortgage fraud in your name.

Who Qualifies?

You are a class member if Knight Barry Title sent you a notice of the data breach on or around February 1, 2024. If you received a letter from the company informing you that your personal information may have been compromised, you are likely eligible.

Excluded from the class are anyone who opted out by January 16, 2026, the assigned judge, and anyone found guilty of involvement in the ransomware attack itself.

What Can I Get?

The settlement offers three types of benefits, and you can claim all three at the same time:

1. Up to $5,000 for Out-of-Pocket Losses

If you incurred expenses because of the data breach, you can claim reimbursement for documented out-of-pocket losses up to $5,000. Qualifying expenses include:

• Costs of freezing or unfreezing credit reports (incurred on or after August 15, 2023)
• Notary fees, fax charges, postage, copying costs, and mileage
• Long-distance phone charges related to dealing with the breach
• Credit monitoring services purchased because of the breach
• Other protective costs fairly traceable to the data incident

You'll need to provide third-party documentation like receipts, phone records, or bank statements. Handwritten or self-prepared receipts alone aren't enough, but they can be submitted alongside other documentation for additional context.

2. Pro Rata Cash Payment

In addition to the out-of-pocket reimbursement, you can also elect to receive a pro rata cash payment from whatever remains in the settlement fund after attorneys' fees, administrative costs, service awards, out-of-pocket claims, and credit monitoring enrollment costs have been deducted. This means every qualifying class member who submits a claim gets a share of the leftover money.

3. Three Years of Free Credit Monitoring + $1 Million Insurance

Every class member who submits a claim is eligible for three years of free identity theft protection and credit monitoring, which includes:

• Credit monitoring with at least one major credit reporting agency
• Identity restoration and recovery services
• $1,000,000 in identity theft insurance with no deductible

You must submit your claim form by February 17, 2026 to be eligible. Once the settlement becomes final, you'll have 180 days to activate the monitoring.

Deadline: February 17, 2026 (submitted online or postmarked by mail).

If you're claiming out-of-pocket losses, include your supporting documentation with the claim form. If you only want the pro rata cash payment and credit monitoring, just fill out the form — no documentation needed for those benefits.

What Happens If I Do Nothing?

If you do nothing, you will not receive any settlement benefits — no cash, no reimbursement, and no credit monitoring. Your legal claims against Knight Barry Title will be released, meaning you give up the right to sue them over this data breach in the future.

Since the pro rata cash payment and credit monitoring require nothing more than submitting a claim form, there's no reason not to file.

Attorneys' Fees and Service Awards

Class Counsel (Cafferty Clobes Meriwether & Sprengel LLP, Milberg Coleman Bryson Phillips Grossman PLLC, and Laukaitis Law LLC) may receive up to one-third (33.33%) of the settlement fund, or approximately $366,630, plus reasonable litigation expenses. The class representatives may each receive $2,500 in service awards. All amounts are paid from the settlement fund and subject to court approval.
