What is Dairy Milk Farmers Class Action Settlement?

Two class action settlements resolve claims that Dairy Farmers of America, Inc. and Select Milk Producers, Inc. combined and conspired in restraint of trade to suppress competition and the prices paid to Southwestern dairy farmers for raw Grade A milk during the Settlement Class Period. Defendants deny wrongdoing. If approved, the settlements will also resolve claims against Greater Southwest Agency.

What is the Total Settlement Amount?

$34,400,000 total class action settlement fund including:

• DFA (Dairy Farmers of America) for $24,500,000 and
• Select Milk Producers for $9,900,000.

How Do I Qualify For a Payout?

You are included if you produced Grade A milk and sold Grade A milk independently or directly or through an agent to DFA and Select within DFA’s Southwest Area region from January 1, 2015 through June 30, 2025. The Southwest Area includes all of New Mexico, most of Texas except the eastern portion, the Oklahoma panhandle, eastern Arizona, and southwestern Kansas. Excluded: DFA and Select and any of their management officers, management, employees, subsidiaries, or affiliates, legal counsel, heirs, or assigns; any entity in which any Defendant has a financial interest; all governmental entities; any presiding judicial officer and immediate family and staff; any other Defendant or co conspirator identified in this action; and anyone who timely excludes themselves.
