What Was the Torrid Lawsuit About?
The lawsuit alleged that Torrid deceptively advertised discounts on Torrid.com by comparing sale prices with reference prices that plaintiffs said did not reflect genuine former prices. Plaintiffs asserted claims under California, Oregon, and Washington consumer-protection laws, along with unjust-enrichment and misrepresentation theories. Torrid disputed the allegations, maintained that its advertising was lawful and accurate, and denied wrongdoing or liability. Who Was Included in the Settlement?
The settlement class covered consumers who resided in California, Oregon, or Washington, as determined by the billing address on the order, and purchased products through Torrid.com from January 1, 2020, through February 18, 2025. The settlement did not cover every Torrid shopper nationwide, purchases outside the stated period, or purchases that did not use a qualifying billing address. Government entities, Torrid-related parties, the presiding judicial officers, and people who timely excluded themselves were among the exclusions described in the notice.What Benefits Did the Settlement Provide?
Each participating class member was assigned one benefit worth $15. A class member who timely submitted a valid claim could elect a cash payment by check or electronic payment. A class member who stayed in the class but did not make that election was designated to receive a $15 store credit instead. The official notice says the store credit does not expire, is transferable, may be combined with another Torrid discount or offer, and applies before taxes and shipping. It is not a recurring credit and is limited to one qualifying order or store purchase.How Was the $11 Million Value Calculated?
The parties estimated that approximately 728,502 people belonged to the class. Multiplying one $15 award by that estimated class size produced an estimated consumer-benefit value of $10,927,530. That figure was not a cash fund divided pro rata among claimants. Torrid also agreed to pay approved notice and administration expenses, attorney fees, and court-approved incentive awards without reducing the face value of each class member’s $15 benefit.What Did the Historical Cash Claim Require?
A cash claimant had to complete the settlement form by the August 26, 2025 deadline and attest under penalty of perjury that the claimant resided in a covered state and made a qualifying Torrid.com purchase during the class period. The online process used settlement-notice credentials for identified class members. The form did not turn the award into reimbursement for a particular purchase amount: an approved claimant still received the fixed $15 cash benefit. The filing period has ended, and this page does not provide a way to submit or reopen a claim.What Happened If a Class Member Did Nothing?
Doing nothing was different from filing a cash claim. A person who remained in the class was assigned the $15 store-credit benefit and became bound by the settlement release. The official notice also stated that an issued cash check that was not cashed before becoming void would default to a store-credit benefit. Someone who timely opted out received neither settlement benefit but retained any individual rights described in the notice.What Does Final Approval Mean Here?
Final approval means the court approved the settlement and entered the order now posted by the administrator. It does not by itself identify the date on which a particular check, electronic payment, or store-credit email was sent. The public homepage and FAQ continue to display the historical hearing schedule and do not provide a later distribution-completion announcement.
