What Changed Recently?
Simplilearn Americas, Inc., which sells online courses and certification programs, agreed to pay $3 million to settle claims that it disclosed platform users’ personally identifiable information — including records of the videos they requested and watched — to third parties without consent, in violation of the federal Video Privacy Protection Act. The original complaint, filed in federal court in Massachusetts in February 2025, alleged the data went to the analytics companies Amplitude and WebEngage. Simplilearn denies any wrongdoing, and no court has decided who is right.
That case, Korn v. Simplilearn Americas, Inc., No. 1:25-cv-10461, survived Simplilearn’s motion to transfer or dismiss on February 19, 2026. The parties mediated on June 4, 2026 and reached an agreement in principle on August 4, 2026. The Massachusetts case was then voluntarily dismissed, and the settlement was filed for approval in Beninati v. Simplilearn Americas, Inc., Case No. 2026-016188-CA-01, in the Circuit Court of the Eleventh Judicial Circuit in Miami-Dade County, Florida. Judge Daryl E. Trawick granted preliminary approval on September 16, 2026.
Who Qualifies?
The settlement class is all persons who accessed or used the Simplilearn platform in the United States from February 26, 2023 through September 16, 2026. The platform means Simplilearn’s iOS and Android apps, its website (including dashboards) and its learning portals. Under the settlement’s definition, a person “accessed or used” the platform by visiting, browsing or interacting with any part of it, whether or not they created an account, subscribed, bought anything or watched a video.
Receiving a payment is narrower than being in the class. The claim form requires each claimant to declare under penalty of perjury that during the class period they had a Simplilearn account and used it to watch at least one pre-recorded video on the website or app. Judges presiding over the case and their families, and Simplilearn, its affiliates and their officers, directors and employees, are excluded.
How Much Can You Get?
Every approved claimant receives an equal, pro rata share of the net settlement fund. The $3 million fund is non-reversionary, and it also pays notice and administration costs, attorneys’ fees of up to 40% ($1.2 million) plus expenses, and service awards of up to $2,500 for each of the two class representatives — all subject to the court’s approval. The settlement notice does not estimate a per-person amount; it depends on how many valid claims are filed.
Checks that are not cashed within 180 days are redistributed to claimants who cashed their checks if each would receive at least $5; otherwise the leftover money goes to a nonprofit approved by the court.
What Proof or Notice ID Is Required?
No receipts or screenshots are required. The online claim portal asks for the Claim ID and PIN printed on the notice that was emailed or mailed to class members from Simplilearn’s records. The claim itself is an attestation: name, contact information, a payment choice and a sworn statement about having an account and watching a pre-recorded video. The settlement website also posts a paper claim form on its Court Documents page that can be completed and mailed.
What Is the Deadline?
Claims must be submitted online by December 15, 2026, or mailed with a postmark no later than December 15, 2026. Requests to be excluded and objections are also due December 15, 2026. The notices do not specify a time zone.
How Do You Take Action?
Claims are filed through the official Simplilearn Privacy Settlement website, run by the court-appointed administrator, Verita Global. The online form takes the Claim ID and PIN from the notice, contact information, a payment method — check, Venmo or PayPal — and the signed attestation. The settlement agreement, long-form notice and preliminary approval order are on the website’s Court Documents page.
What Happens Next?
Class counsel, Bursor & Fisher, P.A., is to file its request for attorneys’ fees by November 30, 2026. The court has not yet set the date, time or format of the final approval hearing, which the notice says is expected in January 2027; the details will be posted on the settlement website. If the court grants final approval, payments are due within 60 days after the settlement’s effective date, which comes after any appeals are resolved.
Do I need a Simplilearn account to get paid from the settlement?
The settlement class includes anyone who accessed or used the Simplilearn platform in the U.S. from February 26, 2023 through September 16, 2026, with or without an account. To receive a payment, though, the claim form requires an attestation under penalty of perjury that the claimant had a Simplilearn account and used it to watch at least one pre-recorded video on the website or app during that period.
How much is each Simplilearn settlement payment?
No per-person estimate has been published. Every approved claimant receives an equal share of what is left of the $3 million fund after administration costs, attorneys’ fees of up to $1.2 million plus expenses, and service awards of up to $2,500 for each of the two class representatives. The share depends on how many valid claims are filed.
Is the Simplilearn settlement the same case as Korn v. Simplilearn in Massachusetts?
It resolves the same claims. Korn v. Simplilearn Americas, Inc. was filed in federal court in Massachusetts in February 2025 and was voluntarily dismissed in August 2026 after the parties agreed to settle. The settlement is being approved in Beninati v. Simplilearn Americas, Inc., Case No. 2026-016188-CA-01, in the Circuit Court for Miami-Dade County, Florida, where the Massachusetts plaintiff is also a class representative.
How will Simplilearn settlement payments be sent?
Claimants choose a check, Venmo or PayPal on the claim form; a check is the default. Payments are due within 60 days after the settlement’s effective date, which follows final approval and the end of any appeals. Checks expire 180 days after they are issued.
What claims are released by the Simplilearn settlement?
According to the notice, the release is broader than the Video Privacy Protection Act claim in the lawsuit. It covers claims arising from the same facts about the collection, use, disclosure or sharing of information through the Simplilearn platform, including through pixels, cookies, software development kits and other tracking or advertising technologies. Class members who do not exclude themselves by December 15, 2026 release those claims whether or not they file a claim.
