What Changed Recently?
The case, Milito v. Belcan Engineering Group, LLC, No. 24-2-20265-0 SEA, was filed in
King County Superior Court in September 2024 under the pay transparency provision of
Washington’s Equal Pay and Opportunities Act, RCW 49.58.110. The complaint alleged that Belcan’s
job postings for Washington positions did not include the wage scale or salary range, and it
sought $5,000 in statutory damages for each applicant. The case was paused while the Washington
Supreme Court decided Branson v. Washington Fine Wine & Spirits, a ruling on who counts
as a job applicant under the law, and settled afterward.
Judge Haydee Vargas granted preliminary approval on August 21, 2026, and the administrator,
Simpluris, sent the notice and claim form on October 5, 2026. The settlement covers both Belcan
Engineering Group, LLC, the company originally sued, and Belcan Services Group, LLC, the affiliate
whose posting the named plaintiff applied to. Belcan denies the claims and says it did
not violate the law, and the court has not ruled on the merits.
Who Qualifies?
The settlement class is everyone who, from January 1, 2023 through August 21, 2026, applied for a
job opening in Washington with Belcan where the job posting did not disclose the wage scale or
salary range to be offered. Belcan has represented that there are 919 class members, identified
from its own records; each was mailed and emailed a personalized notice.
Someone who believes they applied but did not get a notice can raise it with the administrator.
Under the agreement, those disputes must reach the administrator within 30 days of the
October 5, 2026 mailing, and Belcan’s records control unless the person has documents showing they belong on the
class list.
How Much Can You Get?
Every class member who files a valid claim receives the same amount. The notice puts the
estimate at $1,292.77; each person’s estimate is also printed on the claim form that came
with the notice. The actual amount depends on how many people claim and what the court awards in
fees and costs.
A floor and a ceiling: Belcan pays at least $1,102,431.67 and at most $1,650,000,
depending on participation. If 460 or fewer people claim, Belcan pays the minimum and the
claimants split what remains of it. Each claimant beyond 460 adds $1,191.60 to the amount
paid out, up to the $1.65 million cap.
At full participation: if all 919 class members claimed and the court awarded the
requested fees and costs in full, the $1.65 million maximum would leave about $1,217 each.
What comes out of the fund: class counsel’s request of $486,750 in fees (about
29.5% of the maximum) plus up to $5,000 in costs, a $20,000 service award for the class
representative, and up to $20,000 for administration. Administration money left unspent is
added to class members’ payments.
Nothing goes back to Belcan: anything left of the minimum fund after payments goes
to the Legal Foundation of Washington.
Payment form: mailed checks, valid for 180 days. The agreement treats the payments
as non-wage damages reported on Form 1099. Questions about taxes are for the IRS or a tax
professional.
What Proof or Notice ID Is Required?
Filing online requires the LoginID and PIN printed on the personalized notice. No pay stubs or
other documents are needed; eligibility comes from Belcan’s application records. The claim form
can also be returned by email or mail. Class members who cannot find their LoginID and PIN can
request them from Simpluris by giving their full name and mailing address. All claims go through a
verification process, and the administrator may ask for more information.
What Is the Deadline?
Claims: submitted online or by email, or mailed postmarked, by December 4, 2026. The
notice gives no time of day. Under the agreement, a late claim is paid only at Belcan’s
discretion.
Opt-out: a signed letter to the administrator, postmarked by December 4, 2026. Opt-outs
cannot be made by phone or email.
Objections: filed with the court and mailed to counsel for both sides by December 4,
2026.
Final approval hearing: January 7, 2027 at 9:00 a.m., in person at the King County
Courthouse in Seattle or by Zoom.
How Do You Take Action?
Claims are filed on the official settlement website,
EPOASettlementBEG.com,
by entering the LoginID and PIN from the notice. The website also lists the important dates,
posts the court documents and carries the Zoom details for the hearing. The notice embedded below
sets out the opt-out and objection requirements, including where each must be sent.
After the December 4 deadline the court considers final approval, the fee request and the service
award at the January 7, 2027 hearing. If the administrator reports that fewer than 10% of the class
claimed, or more than 10% opted out, Belcan may void the agreement. Once approval becomes final,
the agreement gives Belcan 45 days to fund the settlement and the administrator 14 more days to mail
checks. Checks not cashed within 180 days are sent to Washington’s unclaimed property program in
the class member’s name.
