What Changed Recently?

The court’s August 8, 2026 preliminary approval order started the claims process in McClelland et al. v. Lily Transportation, LLC et al., a class action in Thurston County Superior Court over job postings for positions in Washington. The plaintiffs alleged that Lily Transportation, LLC and Lily Transportation Corp. violated Washington’s pay transparency law, RCW 49.58.110, by posting Washington job openings without the required wage scale or salary range.

Lily Transportation denies the allegations and denies any liability, and the settlement is not an admission of wrongdoing. The court has not decided whether the company broke the law.

Who Qualifies?

The settlement class covers people who, from January 1, 2023 through December 10, 2025, applied for a job opening in Washington with Lily Transportation where the job posting did not disclose a wage scale or salary range. The company estimates there are about 456 class members, and its records identify who received notice.

Anyone who believes they belong in the class but was left off the list has 60 days from the notice mailing to raise it with the settlement administrator. Lily Transportation’s records control unless the person can show with documents that they should have been included.

How Much Can You Get?

Every class member who files a timely, valid Claim Form receives an equal share of the net settlement fund. The notice estimates the payment at $606.31, and the settlement caps each payment at $5,000.

The size of the fund depends on how many people file. Lily Transportation pays a minimum of $317,760 if 228 or fewer people submit valid claims. For each valid claimant beyond 228, the net fund increases by $603.31, up to a maximum total settlement of $456,000. That total also covers requested attorneys’ fees of $134,520, up to $15,000 in costs, $15,000 in service awards for the two class representatives, and up to $15,000 in administration costs, all subject to court approval. Any amount that would push a payment above $5,000 goes to the Legal Foundation of Washington.

The settlement treats the payments as non-wage statutory damages reported on IRS Form 1099. These figures are estimates, and the final amount depends on the number of valid claims and the court’s rulings on fees and awards.

What Proof or Notice ID Is Required?

Proof is required. The online claim portal asks for the LoginID and PIN printed on each class member’s personalized notice. A class member who cannot find them can request them from the settlement administrator by giving their full name and mailing address. The Claim Form can also be returned by mail or email instead of online.

No receipts or pay records are needed, but every claim goes through a verification process and the administrator may ask for more information. Class membership itself is based on Lily Transportation’s application records.

What Is the Deadline?

Claim Forms must be submitted online or by email, or mailed with a postmark, no later than November 23, 2026. The same date is the deadline to request exclusion or file an objection. The settlement agreement allows a late claim to be considered only at Lily Transportation’s discretion.

How Do You Take Action?

Claims are filed on the official Lily Transportation settlement website using the LoginID and PIN from the notice. The site also posts the notice, the settlement agreement and the court’s key dates. Class members whose mailing address changes are told to update it with the administrator so the check reaches them.

What Happens Next?

The final approval hearing is set for February 26, 2027, at 9:00 a.m. before Judge Schaller, with a remote option posted on the settlement website. If the court approves the settlement and no appeal delays it, Lily Transportation funds the settlement within 45 days of the effective date, and the administrator distributes payments within 14 days after that. Checks expire 120 days after issuance. Hearing dates can change by court order.

Questions

Why could the Lily Transportation payment be higher than $606?

The fund grows with participation. Lily Transportation pays a minimum of $317,760 if 228 or fewer of the roughly 456 class members file valid claims, and the net fund rises by $603.31 for each additional claimant up to a $456,000 maximum. Each claimant receives an equal share, capped at $5,000, and any amount above the cap goes to the Legal Foundation of Washington.

Does applying for a Lily Transportation job automatically make someone a class member?

Only if the application was for a job opening in Washington, was made between January 1, 2023 and December 10, 2025, and the posting did not disclose a wage scale or salary range. Lily Transportation’s records control who is on the class list; someone who believes they were left off has 60 days from the notice mailing to raise it with the administrator, and documentary evidence is needed to overturn the company’s records.

Is a late Lily Transportation claim ever accepted?

The settlement agreement says a Claim Form submitted after the deadline will be considered for payment only at Lily Transportation’s discretion. Claims must be submitted online, emailed, or mailed with a postmark no later than November 23, 2026.

How long will settlement checks stay valid?

Checks expire 120 days after they are issued. Money from uncashed checks is sent to the State of Washington’s unclaimed property program in the class member’s name.
