Businesses and charitable organizations that operated within one mile of the Winston Weaver fertilizer facility in Winston-Salem, North Carolina, on January 31, 2022, and that experienced economic or nuisance-related harm from the fire and the mandatory evacuation may qualify. The Business Class covers business and economic losses only — it does not cover personal injury.
An eligible Business Class Member can file for a flat $10,000 payment with no documentation, or submit a documented claim for extraordinary economic loss or property damage with supporting records. The total Business Class settlement fund is $4,500,000, so payments may be adjusted on a pro rata basis depending on the number and size of claims filed.
No documentation is required to claim the flat $10,000 payment — a business only needs to confirm it operated within the evacuation zone on January 31, 2022. Documentation is required only if a business wants to claim more than the flat amount for extraordinary loss or property damage.
The claim filing deadline for the Business Class is July 15, 2026. Claims can be submitted through the official settlement website.
