What Is the Emanate Health Pixel Privacy Settlement About?
Emanate Health Medical Center has agreed to settle a class action lawsuit alleging that its
use of website analytics tools — like the Meta Pixel — on its public website disclosed
patients' personal information to third parties such as Facebook without consent (referred to
in the case as the "Pixel Disclosure"). Plaintiffs allege the information shared through those
analytics tools may have included personally identifying information and protected health
information. Emanate denies the claims and any wrongdoing, and the court has not decided who is
right; both sides agreed to settle to avoid the cost and uncertainty of continued litigation.
The lawsuit is captioned Ortega, et al., v. Emanate Health Medical Center, Case No.
22STCV28142, and is pending in the Superior Court of the State of California, County of Los
Angeles. Under the settlement, Emanate will pay a gross amount of $777,000, and eligible
California users can submit a claim for a pro rata cash payment from the resulting Net
Settlement Fund. The claim deadline is September 29, 2026.

Who Qualifies for the Emanate Health Settlement?
You are a Settlement Class Member if, at any time from August 30, 2019 through April 30, 2024,
you did any of the following:
Logged into the Emanate patient portal; and/or
Submitted an online form on Emanate's public website; and/or
Scheduled an appointment on Emanate's public website, emanatehealth.org.
Specifically excluded from the class are Emanate and its affiliates, parents, subsidiaries,
officers, and directors; anyone who timely opts out of the settlement; and the judges
presiding over the matter and their clerks. The Settlement Administrator sent notices with a
unique Settlement Class Member ID to identified class members by email or mailed postcard. If
you received that notice, you are on the eligibility list. If you believe you qualify but
cannot find your notice, you can request your Settlement Claim ID through the official
settlement website.
How Much Can You Get?
Each Settlement Class Member who submits a valid, timely claim receives a pro rata (equal)
share of the Net Settlement Fund. Emanate is paying a gross settlement of $777,000. After
deductions for notice and administration costs (estimated at about $54,291), service awards to
the four class representatives ($2,500 each, or $10,000 total), attorneys' costs and expenses
(not to exceed $20,000), and attorneys' fees of up to 33% ($259,000, subject to court
approval), the Net Settlement Fund is estimated to be about $433,709.
Because the payment is pro rata, the exact per-person amount depends on how many people file a
valid claim. The notice provides two illustrations: if every class member files, each valid
claim would be worth roughly $11; if about 20% of class members file, each valid claim would
be worth roughly $55. Any funds remaining after distribution would go to a cy pres recipient,
the Electronic Frontier Foundation, a nonprofit focused on digital privacy.
Payments are issued by electronic method — PayPal, Venmo, or Zelle — or by mailed check,
depending on the option you select on the claim form.
How to File an Emanate Health Claim
There are two ways to file, both with the same September 29, 2026 deadline:
Online: Go to the official settlement website and enter the Settlement Claim ID printed on your email or mailed notice. Confirm your contact information and choose your payment method (PayPal, Venmo, Zelle, or mailed check). Online claims must be submitted by 11:59 p.m. Pacific Time on September 29, 2026.
By mail: Complete the paper claim form with your name, Settlement Class Member ID, and payment preference, sign it, and mail it to the Settlement Administrator. Mailed claims must be postmarked no later than September 29, 2026.

The Court still has to decide whether to grant final approval. Payments for valid, timely
claims will only be made after the Court grants final approval and after any appeals are
resolved. If you do nothing, you will not receive a payment, and unless you opt out you will
give up the right to sue Emanate over the privacy claims this settlement resolves.
What Is the Meta Pixel and What Did Emanate Allegedly Do?
The Meta Pixel is a snippet of JavaScript code that websites embed to track visitor behavior
and send that data back to Meta (the parent company of Facebook and Instagram) for advertising
and analytics. The Ortega lawsuit alleges that Emanate used the Meta Pixel and similar
website analytics tools on emanatehealth.org, and that those tools transmitted patients'
personally identifying information and protected health information to third parties without
consent. The complaint asserts claims for:
Violation of the California Confidentiality of Medical Information Act (CMIA);
Invasion of privacy under the California Constitution; and
Intrusion upon seclusion.
Emanate denies all of the allegations and any wrongdoing, and the settlement is not an
