The $28 million SiriusXM telemarketing settlement in Campbell et al. v. Sirius XM Radio Inc., No. 2:22-cv-02261 (C.D. Ill.), has been approved but has not paid out. Chief Judge Colin S. Bruce entered the final approval order and final judgment on July 6, 2026. On August 27, 2026, objector Nigel Cohen filed a notice of appeal to the U.S. Court of Appeals for the Seventh Circuit, which docketed the case the next day as No. 26-2779.
Payments are issued only after the settlement becomes final, and an appeal of the approval order keeps that from happening until the appeal is decided or dismissed. The official settlement website says the approval process may involve appeals that must be resolved before any payments can be issued. No payment date had been announced as of October 5, 2026.

Cohen was the only class member to object. Cohen filed one objection to the settlement and one to class counsel's fee request, and Cohen's counsel appeared at the June 26, 2026 final approval hearing. The July 6 order overruled both, finding the settlement fair, reasonable and adequate and the fees in line with the market for common-fund cases. Forty-seven people opted out of the class.
On July 14, 2026, Cohen asked the court to reconsider, arguing that the National Consumer Law Center should not receive leftover settlement funds as the cy pres recipient because of past professional ties to one of the class counsel firms. The court wrote that a reconsideration motion cannot introduce publicly available information that could have been raised earlier, but the plaintiffs, after conferring with SiriusXM, withdrew their request to name that organization. On July 29, 2026, the court denied the motion as moot and wrote that settlement administration should proceed without further delay.
Cohen then filed a notice of appeal on August 27, 2026, challenging the final approval order and a related June 16, 2026 order. The district court sent the short record to the Seventh Circuit the same day.
The final approval order sets out the deductions. It awarded class counsel one-third of the $26,620,000 net settlement fund — $8,873,333.33 — plus $167,882 in costs, and a $10,000 service award to each class representative. By OpenClassActions' arithmetic, roughly $17.5 million remains for claimants.
Spread across the 427,627 claims reported in April 2026, that is about $41 per claim if every claim is valid, close to the administrator's April estimate of $39.63 per class member. Payments are pro rata, so claims rejected in validation raise the share for everyone else. The administrator filed a declaration on claims validation and estimated payments on June 25, 2026 (ECF No. 156), but it is not publicly posted, so the official per-claim figure may differ. An appeal that changed the fee award or the settlement terms could also change the amount.
The appeal now proceeds on the Seventh Circuit's briefing schedule. Federal appeals of class settlement approvals commonly take months to brief and decide, and an appeal can also end earlier if it is voluntarily dismissed. If the approval is affirmed or the appeal ends, the settlement becomes final and the administrator can begin distribution; the date will be posted on the official settlement website, SXMTCPASettlement.com.
Claimants who filed by the March 21, 2026 deadline do not need to file again. Payments go out through the method chosen on the claim form, and the official website says claimants are responsible for keeping that payment information current with the administrator. Settlement payments do not require a fee.
