What Happened?
Between March and May 2024, an unauthorized third party gained access to the computer network of Axip Energy Services, LP. The cyberattack compromised the personal information of current and former employees, as well as certain other individuals whose data was in Axip's systems. The breach was disclosed publicly on or about August 21, 2024, when Axip notified state Attorneys General and sent individual notices to affected people.
The lawsuit alleges that Axip failed to adequately protect this information and asserts claims including negligence, unjust enrichment, and breach of implied contract. Axip denies all allegations and any wrongdoing.
What Is Axip Energy Services?
Axip Energy Services, LP is a Texas-based energy services company that provides pipeline integrity, inspection, and maintenance services to oil and gas companies. If you worked for Axip — either as a current or former employee — or if your personal information was otherwise stored in their systems, your data may have been exposed in the breach.
This is primarily an employee data breach. Most people affected were workers whose employment records (including Social Security numbers and other personal details) were stored on Axip's network.
Who Qualifies?
You qualify if you are a U.S. resident who received a "Notice of Data Breach" from Axip Energy Services published on or about August 21, 2024. This includes current and former employees and any other individuals whose personal information was compromised in the March–May 2024 cyberattack.
What Can You Get?
$63 Cash Payment (no proof needed). Every class member who files a valid claim receives a one-time cash payment of $63. No documentation required — just file the claim form.
Up to $3,000 for Documented Losses. If you suffered out-of-pocket expenses or financial losses directly caused by the breach, you can claim reimbursement for documented extraordinary expenses up to $3,000 total per person. This $3,000 cap includes the $63 cash payment — so you can claim up to $2,937 in additional documented losses on top of the $63.
Eligible documented expenses include: unreimbursed bank fees, long-distance phone charges, cell phone charges (if billed by the minute), data charges (if billed by usage), postage, gasoline for local travel, credit report and monitoring fees purchased between March 1, 2024 and December 1, 2025, and monetary losses from documented identity theft, fraud, or similar criminal activity that occurred in the same period.
All expenses must be documented with receipts or other proof, must be directly caused by the breach, must not already be reimbursed, and you must show you made reasonable efforts to avoid or recover the loss.
3 Years of Credit Monitoring. All class members who file a claim also receive three years of free credit monitoring from three credit bureaus. This is in addition to any free monitoring Axip may have already offered after the breach was first disclosed.

This settlement requires a claim form. If you do nothing, you get no money, no credit monitoring — and you still give up the right to sue Axip over the breach.

Attorneys' Fees
Class Counsel (Sanford Law Firm and Chestnut Cambronne PA) will request up to $120,000 in attorneys' fees, costs, and expenses. This amount is paid by Axip separately from all class member benefits — it does not reduce payments to class members. A service award of $5,000 is being requested for class representative Robert S. Garner. The service award is also separate from class member benefits.
What Happens If I Do Nothing?
If you do nothing, you receive no benefits — no cash, no credit monitoring. You also give up the right to sue Axip over the data breach. You must file a claim to receive anything from this settlement.
