Can I File a Claim Right Now?
Yes. The claim form is open now. You can file online at ECHDataSettlement.com. The deadline to file is May 11, 2026. You can also mail a paper claim form postmarked by the same date. If you do not file a claim, you will not receive any money, even if you are a class member.
You qualify if you are a U.S. resident whose personal information was compromised in the Eureka Casino Hotel data breach that occurred between November 9 and November 13, 2022. How Much Money Can I Get?
There are three types of payments available. You can claim one or more depending on your situation:
Documented Out-of-Pocket Losses (up to $5,000): If you suffered actual monetary losses because of the data breach — such as unreimbursed bank fees, identity theft costs, credit monitoring expenses, or other documented out-of-pocket costs — you can claim reimbursement up to $5,000. You must provide documentation such as bank statements, receipts, or credit reports showing the loss. The loss must have occurred between November 9, 2022 and the claim deadline, and must have been more likely than not caused by the breach. You must also show you made reasonable efforts to avoid or seek reimbursement for the loss. Self-prepared documents like handwritten receipts alone are not enough. This amount may be reduced pro rata if total claims exceed the settlement fund.
California Statutory Cash Payment ($100): If you lived in California at any time between November 9, 2022 and the claim deadline, you are entitled to an additional $100 cash payment. You just need to attest (swear) that you were a California resident. This may be adjusted pro rata if total California claims exceed the fund allocation.
Pro Rata Cash Payment (no proof required): After documented loss claims, California payments, administration costs, attorney fees, and service awards are paid, any money remaining in the settlement fund will be divided equally among all class members who filed a valid claim for this benefit. You do not need to provide any documentation for this payment — just file the claim form.

What Happened in the Data Breach?
Between November 9 and November 13, 2022, Eureka Casino Hotel (operated by Rancho Mesquite Casino, Inc.) experienced a data security incident in which unauthorized individuals copied personal information from the casino's computer network. The types of data compromised included full names, Social Security numbers, financial account numbers, passport numbers, and driver's license or state-issued identification numbers.
Eureka Casino Hotel is located in Mesquite, Nevada. After discovering the breach, the company sent notification letters to individuals whose information may have been affected. Eureka denies the plaintiffs' claims and denies any wrongdoing. The parties agreed to settle to avoid the costs and disruption of further litigation.

What Happens If I Do Nothing?
If you do nothing, you will remain in the settlement class and give up your right to sue Eureka Casino Hotel over the data breach, but you will not receive any money. To receive a payment, you must file a claim by May 11, 2026.
Can I Opt Out?
Yes. If you want to keep your right to sue Eureka Casino Hotel on your own, you can exclude yourself from the settlement. Your written exclusion request must be postmarked by April 9, 2026 and mailed to the settlement administrator. If you exclude yourself, you will not receive any money from the settlement.
