What Changed Recently?

The settlement resolves P.I.T. Retrievals, LLC v. HealthPort Technologies, LLC, No. GD-13-023729, a class action in the Court of Common Pleas of Allegheny County, Pennsylvania, before Judge Alan D. Hertzberg. The lawsuit alleges that HealthPort, a medical records release company now known as Datavant LLC, breached an implied contract by charging more than the fee ceiling in the Pennsylvania Medical Records Act for copies of records requested in connection with life and health insurance applications. HealthPort denies the allegations. It contends the Medical Records Act does not apply to records requested by a third party for an insurance application, and that the payments were voluntary. The court has not decided who is right; the court-approved notice and settlement website are now live.

This is a different case from the HealthPort/Datavant settlement in Landay v. Datavant, No. GD-09-012923, which covers other Pennsylvania medical records requests and has its own notice, portal and deadlines. Some people may receive notices for both.

Who Qualifies?

The settlement class is all patients, patient designees and patient representatives that requested medical records from a Pennsylvania healthcare provider or facility in connection with patients’ applications for life and/or health insurance — what HealthPort called “underwriting” requests — and who paid HealthPort more than the maximum basic, search and retrieval, and/or reproduction fees set by 42 Pa.C.S. § 6152(a)(2)(i) of the Pennsylvania Medical Records Act, and who were not charged an agreed-upon rate, from December 17, 2009 through July 23, 2026. The court notice says this can include individuals, lawyers, law firms and companies that requested and paid for the records.

Excluded are present or former counsel for HealthPort in the case, the court and its family and staff, and class counsel. The settlement agreement puts the class at approximately 2,056 persons and entities identified from HealthPort’s records.

How Much Can You Get?

An approved claim receives 67.5% of the alleged overpayment — the amount paid above the Medical Records Act maximums for basic fees, search and retrieval fees and per-page copying fees — for each covered request, as calculated by the settlement administrator from HealthPort’s invoice records. There is no flat payment; each claimant’s amount depends on their own transactions, and the Proof of Claim on the settlement website lists each invoice and the settlement benefit attached to it.

HealthPort will make up to $197,720.39 available to pay valid claims. If valid claims add up to more than that, each payment is reduced pro rata. If valid claims add up to less, the settlement agreement provides that the unused money is returned to HealthPort. Class counsel’s fees and costs — which counsel will ask the court to set at no more than $65,906.80 — and a $2,500 service award to the class representative are paid by HealthPort separately and do not reduce class members’ payments.

What Proof or Notice ID Is Required?

No receipts are needed, because the amounts come from HealthPort’s own records. But filing is gated on the Class Member ID — the Notice ID and PIN printed on the mailed notice — which is used to log in, review the transaction list and submit the Proof of Claim. Because a class member who did not receive a notice cannot log in, OCA treats this settlement as Proof Required: Yes. The notice says anyone who did not receive a mailed notice listing a Class Member ID should contact the settlement administrator through the official website.

What Is the Deadline?

Proofs of Claim must be received via the settlement website no later than December 31, 2026. The notice does not provide for mailed claim forms. Requests to be excluded must be made in writing by mail and received by November 16, 2026; the notice says postmarks do not count. Written objections must be filed with the court and received by class counsel and HealthPort’s counsel by November 2, 2026.

How Do You Take Action?

Claims are filed on the official HealthPort P.I.T. settlement website, using the “Online Claim Submission” link and the Class Member ID from the notice. The site also posts the long-form notice, the settlement agreement, the preliminary approval papers and the key dates.

What Happens Next?

Judge Hertzberg will hold the fairness hearing on December 1, 2026 at 12:00 p.m. to decide whether to approve the settlement, class counsel’s fee request and the service award. Payments are made only if the court grants final approval and any appeals are resolved; the notice warns that appeals can take more than a year. Under the settlement agreement, HealthPort funds the settlement account within 14 days after the settlement becomes effective.

Questions

Is this the same as the other HealthPort medical records settlement?

No. P.I.T. Retrievals v. HealthPort Technologies, No. GD-13-023729, covers records requested for life and health insurance applications, which HealthPort called underwriting requests. Landay v. Datavant, No. GD-09-012923, is a separate settlement over other Pennsylvania medical records requests, with its own notice, claim portal and deadlines. Both are in the Court of Common Pleas of Allegheny County.

How is the HealthPort underwriting settlement payment calculated?

The settlement administrator uses HealthPort’s invoice records to calculate how much each class member paid above the Pennsylvania Medical Records Act maximum for each underwriting request, and an approved claim receives 67.5% of that amount. HealthPort will make up to $197,720.39 available; if valid claims exceed that, payments are reduced pro rata. Each class member’s transaction list and amount appear on their Proof of Claim on the settlement website.

Can a lawyer, law firm or company claim in the HealthPort underwriting settlement?

Yes, if they fall within the class. The class covers patients, patient designees and patient representatives who paid HealthPort for underwriting records requests, and the court notice says that may include individuals, lawyers, law firms and companies that requested and paid for the records.

Do attorneys’ fees come out of the HealthPort underwriting settlement payments?

No. According to the notice, HealthPort will pay class counsel’s fees and costs, which counsel will ask the court to set at no more than $65,906.80, and a $2,500 service award to the class representative separately from the money available to class members.

When will the HealthPort underwriting settlement pay?

Only after the court grants final approval and any appeals are resolved. The fairness hearing is set for December 1, 2026. Under the settlement agreement, HealthPort funds the settlement account within 14 days after the settlement becomes effective. No payment date has been announced.
