What Is This Settlement About?

Kaiser Permanente agreed to a $46,000,000 settlement (which may rise but cannot exceed $47.5 million) to resolve a class action over its use of third-party web-tracking tools. The lawsuit alleged that Kaiser embedded tracking technologies on its websites and patient portals that transmitted sensitive information — such as appointment details, search activity, and communications — to outside technology and advertising companies without proper consent.

Kaiser denies any wrongdoing, and the Court has not ruled in favor of either side. The case is being resolved through the settlement to avoid the cost and risk of continued litigation. The claim filing window has now closed; this page is maintained as a record of the settlement and its remaining approval steps.

Who Qualified for the Settlement?

The settlement class includes Kaiser Permanente members in California, Colorado, Georgia, Hawaii, Maryland, Oregon, Virginia, Washington, and the District of Columbia who accessed logged-in (authenticated) pages of Kaiser Permanente websites or mobile apps between November 2017 and May 2024.

Covered platforms included Kaiser patient portals and mobile apps such as the Kaiser Permanente App, My Doctor Online, My KP Meds, KP Health Ally, and related Kaiser platforms.

How Much Can Class Members Get?

Each class member who submitted a valid claim receives a pro rata share of the net settlement fund. The Notice estimates individual payments will range between $20 and $40, though the final amount depends on how many valid claims were filed. The net fund is what remains of the $46 million (up to $47.5 million) after notice and administration costs, attorneys' fees of up to $15,675,000 (not to exceed 33% of the fund), litigation costs of up to $900,000, and service awards of up to $5,000 for each of the eight named plaintiffs, all subject to Court approval.

Claimants could elect to receive payment by physical check, electronic Mastercard, Amazon, Target, Venmo, PayPal, or ACH direct deposit.

Can I Still File a Claim?

No. The deadline to submit a claim form was March 12, 2026, and online and mailed claims are no longer being accepted. That same date was the deadline to opt out of or object to the settlement. Class members who filed a valid claim by the deadline do not need to take any further action — payments will be issued after the Court grants final approval.

The Final Approval Hearing was originally set for May 7, 2026 and was continued by the Court to June 25, 2026. Hearing dates can change without further notice, so class members can confirm the current schedule on the official settlement website.

When Will Payments Be Sent?

If the Court grants final approval at the June 25, 2026 hearing, payments to class members who filed valid claims are expected to begin around September 2026. Settlement payments typically occur several months after final Court approval, and any appeals can delay distribution.

Was Proof Required to File a Claim?

Yes. The settlement class was a fixed list of Kaiser members who were sent an email or mailed notice containing a Unique ID issued by the Settlement Administrator, and that identifier was tied to the claim. No purchase receipts were required for the basic cash payment, but a class member who never received (or discarded) the notice and its Unique ID could not readily file — which is why this page treats the settlement as proof-required.
