A Massachusetts state court preliminarily approved the settlement in Cadigan v. The Container Store, Inc., a case filed in 2020 in Suffolk Superior Court, and the claim period opened. The lawsuit alleges that The Container Store's Massachusetts stores used touchscreen kiosks and point-of-sale devices with no non-visual way to enter information, so blind customers could not enroll in or credit purchases to its loyalty program, now called Organized Insider and formerly POP! Perfectly Organized Perks. The complaint relies on the Massachusetts Public Accommodations Act, the Massachusetts Equal Rights Act and the state consumer protection law. The Container Store denies any wrongdoing or violation of state law.
The settlement class covers legally blind individuals in Massachusetts who made purchases at any Container Store location in Massachusetts from July 20, 2011 through August 12, 2026, sought to credit a purchase to a new or existing loyalty program account, and encountered a touchscreen kiosk or device that lacked non-visual methods for entering information.
Purchases at stores outside Massachusetts, and purchases made online, are not part of the cash portion of this settlement. Notice was sent by email to loyalty-program members.
The settlement pays $75 for each qualifying purchase during the class period. The settlement agreement does not set a limit on the number of purchases a class member may list.
The Container Store's total payment is $780,000. Of that, up to $495,000 is set aside for class counsel's fees and costs and up to $55,000 for service awards to the two named plaintiffs, leaving a $230,000 damages fund, which also pays administration costs the notice estimates at no more than $12,500. If valid claims exceed the money available, each class member receives a pro rata share based on the number of qualifying purchases. Any money left over, including from uncashed checks, goes to The Carroll Center for the Blind.
The settlement also requires accessible kiosks that meet WCAG 2.1 AA in The Container Store's Massachusetts stores within seven months of final approval and in its other continental U.S. stores within ten months after that, with at least one working accessible kiosk per store and employee training. California stores are covered by a separate agreement.
The online claim form opens only with the CPT ID and Passcode printed on the notice that was emailed to class members. The settlement website says people without those credentials can ask the administrator for them through the site's contact options.
Every claim, online or on paper, must include proof that the claimant is legally blind. The settlement website lists a Certificate of Blindness, a Massachusetts Commission for the Blind identification card, or medical documentation as acceptable. Receipts are not required: the claim form asks claimants to list each purchase by approximate date, Massachusetts store and city, and purchase details, and to certify the claim under penalty of perjury. The administrator may request supporting information about a claimed purchase.
Claims must be submitted by December 20, 2026. The notice does not give a time of day or timezone for the online deadline. The objection deadline was October 9, 2026. The notice does not publish a separate opt-out deadline; under the settlement agreement, class members may request exclusion only from the monetary relief, not from the injunctive relief.
Claims are filed through the official Container Store settlement website, run by the administrator CPT Group, which also posts accessible versions of the notice and claim form. The claim lists each qualifying purchase and attaches proof of legal blindness. Payments are made by paper check, and checks expire 90 days after they are issued.
The court will consider final approval at a hearing on October 29, 2026 at 2:00 p.m. in Suffolk Superior Court. Payments are distributed after final approval and after any appeals are resolved, and no payment date has been announced.

What counts as proof of legal blindness for The Container Store settlement?
The settlement website lists a Certificate of Blindness, a Massachusetts Commission for the Blind identification card, or medical documentation as acceptable proof. Every claim must include proof that the claimant is legally blind.
Are receipts required to claim $75 per purchase?
