What Changed Recently?

The case is Kaya v. See Inc. d/b/a SeeEyeWear, No. 2026-008574-CA-01, in the Circuit Court of the Eleventh Judicial Circuit in Miami-Dade County, Florida. It began in August 2025 as a federal lawsuit in the Eastern District of Michigan, which was dismissed in April 2026 and refiled in Florida state court that same month.

The lawsuit alleges that SeeEyeWear, a Michigan eyewear company, kept sending marketing texts after people replied STOP, and sent repeat texts to numbers on the National Do Not Call Registry, in violation of the Telephone Consumer Protection Act. SeeEyeWear denies all wrongdoing, and the court has not decided who is right. The parties settled after an April 2026 mediation, and Judge Reemberto Diaz granted preliminary approval on August 6, 2026.

Who Qualifies?

The settlement covers two classes, both limited to people in the United States and texts sent from August 14, 2021 through August 14, 2025: The court’s preliminary approval order puts the two classes at about 227 people combined. People identified from SeeEyeWear’s records were sent notice by email or postcard. SeeEyeWear and its affiliates, officers and employees, the judges involved and class counsel are excluded.

How Much Can You Get?

Each class member who files a valid claim can receive up to $290 for each qualifying text they received. Only one claim is allowed per person, and it covers all of that person’s texts.

SeeEyeWear has agreed to make up to $275,210 available. That fund also pays attorneys’ fees and expenses (class counsel is requesting $82,500, about 30%), notice and administration costs capped at $10,000, and a service award of up to $5,000 for the named plaintiff. If approved claims plus those costs would exceed the fund, every payment is reduced by the same proportion.

Any money left after payments goes back to SeeEyeWear, and so do checks not cashed within 90 days of issue.

What Proof or Notice ID Is Required?

The online claim portal asks for the Claim Number and PIN from the email or postcard notice, so Proof Required: Yes. The claim form also asks for the phone number or numbers that received SeeEyeWear texts, plus a name, address and email. Claimants confirm under penalty of perjury that they received more than one SeeEyeWear text after opting out or while on the Do Not Call Registry. No receipts or screenshots are required; the administrator checks each claim against SeeEyeWear’s records.

The settlement website says a paper claim form is available from the administrator on request.

What Is the Deadline?

Claims must be submitted online by 11:59 p.m. Eastern on November 27, 2026, or mailed with a postmark no later than November 27, 2026. The deadlines to opt out and to object were October 13, 2026, and have passed.

How Do You Take Action?

Claims are filed on the SeeEyeWear claim portal using the Claim Number and PIN from the notice. The official settlement website posts the notice, settlement agreement and court orders.

What Happens Next?

Judge Diaz will hold the final approval hearing at 8:30 a.m. on November 12, 2026, by Zoom, and will also rule on the fee request and service award. If the settlement is approved and becomes final, the agreement calls for the administrator to mail checks within 45 days. No payment date has been announced, and an appeal would delay payments.

Questions

Can I file a SeeEyeWear claim without the notice?

The online claim form asks for the Claim Number and PIN printed on the email or postcard notice. The settlement website says a paper claim form is available from the administrator on request, and the administrator verifies every claim against SeeEyeWear’s text records.

Will every claimant get the full $290 per text?

Not necessarily. $290 per text is the maximum. If approved claims, attorneys’ fees, administration costs and the service award together exceed the $275,210 fund, every payment is reduced by the same proportion.

What happens to money nobody claims?

Under the settlement agreement, money left in the fund after payments, and checks not cashed within 90 days, go back to SeeEyeWear.

How many people are in the SeeEyeWear settlement?

The court’s preliminary approval order puts the two settlement classes at about 227 people.
