All Active MDLs in 2026: The Complete List of Federal Multidistrict Litigation

Every major product-injury, data-breach, and antitrust fight in the federal courts runs through a multidistrict litigation. Here is the complete, searchable list of all 162 active MDLs, refreshed with the August 2026 JPML figures — case names, MDL numbers, judges, courts, and pending case counts — plus what moved since the July report and where the biggest mass torts actually stand.

The 2026 MDL Landscape at a Glance

A mass tort is not one lawsuit — it is thousands of individual claims that a federal panel groups before a single judge so the shared questions get answered once. That structure, a multidistrict litigation or MDL, is where nearly every product-injury, data-breach, and antitrust fight below is being decided. The figures on this page come straight from the U.S. Judicial Panel on Multidistrict Litigation's (JPML) official statistics report dated August 3, 2026.

"Actions pending" is how many individual cases are currently open in each MDL; "total actions" is the cumulative number ever filed since the MDL began (a big gap between the two usually means the litigation has largely settled). Counts are official JPML figures as of August 3, 2026 and change monthly.



What Changed Since the July Report

The number of active MDLs held at 162, but the caseload inside them grew. Pending actions rose by 1,625 over the month, from 203,915 to 205,540, and lifetime total actions rose from 712,125 to 714,508. Thirty-one dockets grew, 21 shrank, and 109 were unchanged. The list itself also turned over by one on each side: the SAP SE patent litigation (MDL 3158, 4 cases pending in July) is off the active list, and the BPS Direct/Cabela's wiretapping litigation (MDL 3074, 2 pending) is on it.

Nearly all of the month's growth landed in five dockets: The two GLP-1 dockets also kept climbing: the main products-liability MDL (3094) added 80 cases to reach 3,928, and the newer vision-loss docket over non-arteritic anterior ischemic optic neuropathy (MDL 3163) added 54 to reach 200.

Going the other way, the Gardasil litigation (MDL 3036) fell from 129 pending cases to 7, the sharpest drop on the list; Allergan Biocell textured breast implants (MDL 2921) fell 119, to 1,377; and hair relaxer (MDL 3060) fell 98, to 11,779. The Bard hernia mesh docket (MDL 2846) shed 61 cases, to 23,321, consistent with a litigation working through a resolution program. The JPML statistics report gives counts only, not reasons — cases leave an MDL through dismissal, settlement, or remand back to the court where they were filed — so a falling count is not by itself evidence of any particular outcome.

One structural note that the monthly totals hide: the caseload is extremely top-heavy. Twenty-one MDLs hold 1,000 or more pending actions each, and those 21 dockets — about 13% of the list — account for 193,591 pending cases, or roughly 94% of everything pending in the MDL system. At the other end, 38 MDLs have 10 or fewer cases left.

Talcum Powder (MDL 2738): The First Federal Trial Is Finally Near

The talc litigation is the largest on the list. Plaintiffs allege that talc-based body powders were contaminated with asbestos and caused ovarian cancer — allegations Johnson & Johnson denies. The story that dominated 2024 and early 2025 was J&J's attempt to resolve the claims through a subsidiary bankruptcy — the "Texas Two-Step" — tied to a roughly $8 billion proposed payment; a bankruptcy judge rejected that plan in early 2025, pushing the fight back into the MDL. In 2026 a court-appointed special master recommended that plaintiffs be allowed to present their expert witnesses on whether talc can cause ovarian cancer, and the first federal bellwether trial remains on track for later in 2026. Depo-Provera (MDL 3140): A Global Settlement Framework

Depo-Provera is the fastest-moving toward resolution. The claims, brought by women who allege the contraceptive injection caused meningioma (a type of brain tumor), gained momentum after the FDA approved a new Depo-Provera label in December 2025 warning of a potential meningioma association. In June 2026, Pfizer and plaintiffs' counsel told the court they had reached an agreement in principle on a global settlement framework, and the court vacated the first bellwether deadlines (that case had been set for December 2026) while terms are finalized. AFFF Firefighting Foam (MDL 2873): Water Deals Done, Injury Trials Slipping

The AFFF litigation splits into two stories. The water-contamination side is essentially resolved: 3M agreed to pay up to roughly $10.3 billion over 13 years to public water systems, and DuPont, Chemours, and Corteva agreed to about $1.185 billion. The personal-injury side — firefighters and others who allege PFAS "forever chemicals" caused cancer — is a different matter: the first personal-injury bellwether trial, once set for October 2025, was vacated, and the court has been assembling a second bellwether pool focused on drinking-water exposure and specific diagnoses such as kidney and testicular cancer. Hernia Mesh: Bard Settles, Covidien Goes to Trial

"Hernia mesh" is really several MDLs. The largest, against C.R. Bard/Davol (MDL 2846, S.D. Ohio, Judge Sargus), moved into resolution after Bard's parent, Becton Dickinson, announced in October 2024 it would pay more than $1 billion to resolve substantially all U.S. hernia mesh claims. Attention has shifted to Covidien (MDL 3029, D. Mass., Judge Patti Saris), where the first bellwether, Patterson v. Covidien, went to trial in mid-July 2026 after the court denied Covidien's summary-judgment motion and let the failure-to-warn claims reach a jury. The trial was expected to run several weeks, and no verdict had been announced as of the August 3 JPML report. Covidien's docket grew by 24 cases over the month while Bard's shrank by 61. Hair Relaxer (MDL 3060): Still Years From a Payout

Plaintiffs allege that long-term use of chemical hair straighteners increased their risk of uterine and other reproductive cancers; the manufacturers deny the claims. This is the case where search interest and legal reality diverge most: people look for a "hair relaxer settlement amount," but there is no settlement and no settlement figure. The litigation entered its bellwether phase in early 2026, and the first federal bellwether trials are not expected until at least 2027 — meaning any global settlement would likely come later still. Camp Lejeune: $907M Offered, Under 1% Resolved

Camp Lejeune is not an MDL — it is a distinct set of federal claims under the Camp Lejeune Justice Act, filed in the Eastern District of North Carolina — but it is the largest toxic-exposure litigation in the country. The filing window closed on August 10, 2024, so no new claims can be filed. As of mid-2026, the Department of Justice reported settlement offers exceeding $907 million with more than $723 million paid — still under 1% of all filed claims. Philips CPAP (MDL 3014): Paying Out

The Philips Respironics litigation followed the 2021 recall of millions of CPAP, BiPAP, and ventilator devices over concerns about degrading sound-abatement foam. It is the furthest along on the payment side: Philips agreed to a $1.1 billion personal-injury settlement (which includes a medical-monitoring program) and separately resolved economic-loss claims under a roughly $479 million framework. How a Mass Tort Reaches a Payout

Every case above is somewhere on the same path, which is why a list like this is useful. In broad strokes: individual lawsuits are filed and then consolidated into an MDL before one judge; the parties fight over expert evidence (whether the product can cause the injury) and exchange discovery; a handful of bellwether trials test how juries react; and those results usually drive a global settlement, often paid through a point or matrix system that weighs each claimant's injury and exposure.

The timeline is measured in years, not months, and a case can stall at any stage — a rejected settlement, a vacated trial date, an evidentiary ruling. That is exactly what separates the cases here: Depo-Provera and Philips CPAP are near or in the payout phase, talc and Covidien are at the trial stage, and AFFF injury claims and hair relaxer are still in pretrial. As of August 2026, the Depo-Provera MDL (3140) is furthest along toward a global resolution: the parties told the court in June 2026 they had reached an agreement in principle on a settlement framework, and the docket added another 464 cases between the July and August JPML reports. The Philips CPAP (MDL 3014) and Bard hernia mesh (MDL 2846) litigations already have resolution frameworks and are in the payout phase.

Can I still file a Camp Lejeune claim in 2026?
